<br />EXHIBIT B <br /> <br />FINDINGS IN SUPPORT OF CERTIFICATION OF A <br />FINAL ENVIRONMENTAL IMPACT REPORT <br />FOR A PROJECT WHICH INCLUDES <br />ADOPTION OF A DOWNTOWN TRANSIT-ORIENTED DEVELOPMENT (TOD) <br />STRATEGY, <br />REVISIONS TO THE CITY OF SAN LEANDRO ZONING CODE, ZONING MAP AND <br />CREA TION OF S-REVIEW OVERLAY CRITERIA <br /> <br />AND <br /> <br />STATEMENT OF OVERRIDING CONSIDERATIONS <br />FOR APPROVAL OF THE SAME PROJECT <br /> <br />PROJECT DESCRIPTION: <br /> <br />The overall project consists of the Downtown San Leandro Transit-Oriented Development <br />(TOD) Strategy. Individual elements of the project include modifications to the City's zoning <br />code and map amendments, including S-Review Overlay Criteria. The proposed Zoning Code <br />and Zoning Map Amendments are needed to provide a framework for implementing the proposed <br />Downtown TaD Strategy. Implementation of the Downtown TOD Strategy creates opportunities <br />for increased residential densities within an existing urbanized setting with established <br />infrastructure. New opportunities for retail and office development within the Strategy Area <br />could also occur. <br /> <br />The proposed Downtown San Leandro Transit-Oriented Development (TaD) Strategy Area is <br />the 1;2 mile radius around the intersection of East 14th and Davis Streets, representing 502 acres. <br />The Study Area is located in the northern portion of the city and encompasses the downtown <br />core, the downtown BART station area, and the Creekside and Best Manor neighborhoods. The <br />TOD Strategy Area is roughly bounded by East 14th and Georgia Way to the north, Castro Street <br />to the south, Bancroft Avenue to the east, and Orchard Avenue and Davis Street to the west. <br /> <br />The Downtown San Leandro Transit Oriented Development Strategy Final Environmental <br />Impact Report identified significant impacts and significant cumulative impacts associated with <br />the implementation of the project. Approval of a project with significant impacts requires that <br />findings be made by the City of San Leandro, the lead agency, pursuant to CEQA. The <br />significant impacts of the project would be mitigated to a less than significant level with <br />mitigation measures identified in the Final Environmental Impact Report. The significant <br />cumulative impacts would be unavoidably significant, thus requiring a Statement of Overriding <br />Considerations. <br /> <br />I. EFFECTS THAT CAN BE MITIGATED TO A LESS- THAN-SIGNIFICANT <br />LEVEL WITH MITIGATION MEASURES IDENTIFIED AS PART OF THE <br />FINAL ENVIRONMENT AL IMPACT REPORT <br /> <br />The following significant impacts would be mitigated to a less than significant level with <br />mitigation measures identified in the Final Environmental Impact Report, and included below as <br />part of this Statement of Findings document. <br />
