<br />following a 20 month planning effort; and <br /> <br />WHEREAS, on or about May 15, 2007, the City prepared and circulated a Notice of <br />Preparation of a Draft Environmental Impact Report ("DEIR") for the Downtown TOD Strategy; <br />and <br /> <br />WHEREAS, on June 5, 2007, the DEIR for the Downtown San Leandro Transit-Oriented <br />Development (TOD) Strategy was published and circulated for a 45-day public review period <br />ending on July 19, 2007; and <br /> <br />WHEREAS, a Response to Comments document, which together with the DEIR <br />constitutes the Final Environmental Impact Report ("Final EIR"), has been prepared and circulated; <br />and <br /> <br />WHEREAS, in connection with the preparation of the Downtown TOD Strategy, <br />amendments to the San Leandro Zoning Code ("Zoning Code") and San Leandro Zoning Map <br />("Zoning Map") have been proposed in order to implement the Downtown TOD Strategy; and <br /> <br />WHEREAS, a legal ad was placed in the Daily Review and notices were sent to 983 <br />property owners and to another 394 interested parties to inform them of the proposed Zoning Code <br />and Zoning Map changes, and <br /> <br />WHEREAS, on August 17, 2007, the Final EIR on the Downtown TOD Strategy was <br />released and was made available for public review; and <br /> <br />WHEREAS, on August 23, 2007, the City of San Leandro Planning Commission <br />considered the Final EIR on the Downtown TOD Strategy and received public comments thereon <br />and recommended that this Council certify the Final EIR as complete; and <br /> <br />WHEREAS, the San Leandro Planning Commission held a duly noticed public hearing on <br />August 23, 2007, to: (1) review the proposed Zoning Code amendments which would provide "s" <br />Special Review Overlay Criteria and (2) hear public testimony regarding the proposed Zoning Code <br />amendments. Following the public hearing, the Planning Commission recommended that the City <br />Council approve the proposed Creation of Special Review Overlay Criteria for Seven of Eight <br />Special Policy Areas identified in the Downtown TOD Strategy to encourage particular land uses in <br />the area of the Downtown Transit-Oriented Development Study Area; and <br /> <br />WHEREAS, the San Leandro Planning Commission held a duly noticed public hearing on <br />August 23, 2007, to review the proposed Zoning Code amendments which would the Downtown <br />Areas 1-6 (DA-1, DA-2, DA-3, DA-4, DA-5 and DA-6) and Zoning Map amendments which <br />would create S-Overlay Districts on certain properties within the DA-1, DA-4, PS and OS Districts. <br />Following the hearing the Planning Commission recommended that the City Council approve the <br />proposed Downtown Area Districts and create S-Overlay Districts on certain properties within the <br />DA-1, DA-4, PS and OS Districts; and <br /> <br />ORDINANCE NO. 2007-019 <br /> <br />2 <br />
