shall also be properly disposed as required by Federal, State and City's <br />Environmental laws. <br />VI. BUILDING AND FIRE DEPARTMENT REQUIREMENTS <br />A. Prior to Certificate of Occupancy, the project shall comply with all Fire and <br />Building Code standards. <br />B. All necessary building permits shall be obtained, as necessary. A final interior <br />tenant improvement plan shall be submitted to the Building Department and <br />distributed to the Fire Department, as necessary for interior tenant improvements, <br />as significant modifications will need to be made to the proposed tenant <br />improvements plans in order to meet the Fire and Building Code requirements. <br />VII. ENGINEERING REQUIREMENTS <br />A. The proposed development shall comply with City ordinances, policies and <br />regulations. All improvements shall be in accordance with the City's Design <br />Standards, Specifications and Standard Plans unless otherwise specifically approved <br />by the City Engineer. <br />B. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), the <br />City HEREBY NOTIFIES the applicant for this Project that the 90-day approval <br />period (in which the applicant may protest the imposition of any fees, dedications, <br />reservations, or other exactions imposed on this Project by these Conditions of <br />Approval) will begin on the date of the conditional approval of this Project. If you <br />fail to file a protest within this 90-day period, complying with all of the <br />requirements of Government Code Section 66020, you will be legally barred from <br />later challenging any such fees, dedications, reservations or other exactions. <br />C. Applicant shall pay design review fees, development impact fees, permit fees, <br />inspection fees, and any other fees charged by the City or other reviewing agencies <br />for the review, approval, permitting and inspection of the public and/or private <br />improvements. <br />D. Applicant shall pay the Development Fee for Street Improvements (DFSI) prior to <br />issuance of a building permit, credit will be given for the existing use of the <br />building. The exact fees will be determined at the time of Building Permit Issuance <br />and will be adjusted to reflect any change in the ENR Construction Cost Index. <br />E. Applicant shall obtain an Encroachment Permit from the Engineering and <br />Transportation Department for any work within the public right-of--way prior to the <br />issuance of building permits for the project. <br />F. Applicant shall remove any damaged or unused driveways, sidewalk, curb and <br />gutter along the full property frontage and shall construct new City standard <br />driveway, sidewalk, curb and gutter in place of the removed items. <br />Agreement to Conditions July 5, 2007 <br />PLN2007-00026 Page 6 of 8 <br />
