CITY OF SAN LEANDRO <br />MEMORANDUM <br />DATE: October 16, 2007 <br />TO: Finance Committee <br />FROM: Jesse Baloca, Finance Directo <br />BY: Mary Ann Perini, Budget & Compliance Manager <br />Stephanie Stuart, Assistant City Attorney <br />SUBJECT: Ordinance Amending Chapter 4-5, Title 4 of the San Leandro Municipal Code <br />Relating to Peddlers, Solicitors and Itinerant Merchants <br />Recommendation <br />Staff recommends that the Finance Committee approve for forwarding to the City Council the <br />Amendments to the San Leandro Municipal Code Chapter 4-5, Title 4 Relating to Peddlers, <br />Solicitors and Itinerant Merchants (PSIM). <br />Background and Discussion <br />The current PSIM Ordinance was adopted by the City Council with an effective date of August <br />4, 1986. Enhancements to the revised ordinance are described as follows: <br />1. The Ordinance adds additional restrictions that benefit the public good, such as: <br />a. 2-hour maximum parking limit for vehicle or trailer and must move at least 500 <br />feet in any direction from where they were previously parked; <br />b. Must not park vehicle or trailer within 15 feet of .any curb return, driveway or fire <br />hydrant; <br />c. Ice Cream Trucks are prohibited within 500 feet of Primary or Secondary Schools <br />during the half-hour prior to the start of the school day and half-hour following <br />school day dismissal; <br />d. Vehicle or trailer legally parked, self-propelled, within the public right-of-way on <br />city streets and shall not have exclusive rights to any particular location; <br />e. Vehicle or trailer shall not sell food within two blocks or 600 feet, whichever is <br />greater, of an established business with similar food or merchandise; and <br />f. Peddlers are now required to remove and properly dispose of all trash and refuse <br />associated with their business. <br />2. Also, the Ordinance codifies administrative policies that have been in place for several <br />years such as: <br />a. Special Permits are excluded from this ordinance; <br />b. Vehicle stickers are no longer issued or used for identification; <br />c. Food Peddlers are no longer permitted in the Shoreline Recreation Area (Marina); <br />and <br />d. Pushcarts, handcarts or dollies are not permitted in the City of San Leandro. <br />
