WHEREAS, Section 33333.6 of the Health and Safety Code requires the legislative body to hold a public hearing on the amendment following notice of said hearing having been hailed to the governing body of each affected taxing agency no later than 30 days prior to the public hearing; and having published notice of the public hearing in a newspaper of general circulation no later than 10 days prior to the date of the hearing, all of which required actions having been taken; WHEREAS, the legislative body hereby determines that the Agency is in compliance with the requirements of Health and Safety Code Section 33334.2, that the Agency has adopted a current Implementation Plan in compliance with Health and Safety Code Section 33490, that the Agency is in compliance with Health and Safety Code Section 33413, Subdivisions (a) and (b), to the extent applicable, that the Agency is not subject to sanctions pursuant to Subdivision (e) of Section 33334.12 for failure to expend, encumber, or disburse an excess surplus, and that the funds used to make the ERAF payment pursuant to Health and Safety Code Section 33681.12 would otherwise be used to pay the costs of projects and activities necessary to carry out the goals and objectives of the Plaza Redevelopment Plan; NOW, THEREFORE, the City Council of the City Of San Leandro does ORDAIN as follows: Section 1. The time limit of the effectiveness of the Redevelopment Plan for Plaza I and Plaza II-Areas 1, 2, 3, and 4 shall be extended by two (2) years. The time limit for the receipt of property taxes in Plaza I and Plaza II-Areas 1, 2, 3, and 4 pursuant to Section 33670 shall be extended by two (2) years. The Plan Amendment, constituting the Third Amendment to the merged Plaza Redevelopment Project Area, consists of the following additional and/or replacement text as follows (deletions in ~*~~~'-°~ and additions in italics): A) Section 1.04.080(E) of the Plan is amended to read as follows: "Except for the nondiscrimination and nonsegregation provisions which shall run in perpetuity and the provisions of Chapter 1.16, the provisions of this plan shall be effective and the provisions of the documents formulated pursuant to this plan shall be effective until ~ ~~z; 2~i~ January 1, ?01~.'~ B) The following sentence within Section 1.16.030 of the Plan is amended as follows: "Pursuant to Section 33333.6 of the Health and Safety Code, receipt of tax increment to finance, in whole or in part, the redevelopment project will terminate as of ~ ~Ee~~-~~-~ December 28, 2008, except to the extent that debt incurred prior to January 1, 1994 requires repayment and that the Agency must fulfill certain affordable housing obligations."
