Proposed Zoning Code Amendment to add Article 32 <br />EXHIBIT A <br />Article 32 Non-Residential Condominium Conversions <br />Sections: <br />5-3200 Specific Purposes <br />5-3202 Objectives <br />5-3204 Definitions <br />5-3206 Application Requirements and Procedures <br />5-3208 Required Reports and Information <br />5-3210 Condominium Conversion Standards <br />5-3212 Application Notification <br />5-3214 Required Findings <br />5-3216 Referral to Planning Commission <br />5-3218 Appeals <br />5-3220 Retaliation Defense <br />5-3200 Specific Purposes <br />The City of San Leandro finds that the conversion of larger multi-tenanted industrial or <br />commercial properties into smaller ownership units is beneficial to encourage property <br />improvements and to allow ownership opportunities for smaller businesses. In adopting <br />this article, the City seeks to protect the welfare of existing tenants of such property and <br />ensure that the overall property is maintained in optimum conditions in both appearance <br />and in structural integrity. In this article, the City addresses the special attributes of non- <br />residential condominium conversions and adopts condominium conversion standards <br />that will protect the community, existing tenants, and the purchasers of condominium <br />units. Specifically, the purpose of this article is to ensure that any conversion of a non- <br />residential building or complex is preceded by adequate notice to existing tenants and <br />surrounding property owners and businesses, and to provide a review process to <br />address such items as parking, building appearance, property maintenance, lighting, <br />security and signage. <br />5-3202 Objectives <br />This article is enacted for the following reasons: <br />A. To establish procedures and standards for the conversion of existing non- <br />residential establishments to condominium ownership; <br />B, To reduce the impact of such conversions on tenants by providing for <br />procedures for notification; <br />C. To assure that purchasers of converted non-residential units have been <br />properly informed as to the physical condition of the structure that is offered <br />for purchase; and <br />AR.32 <br />Page 1 of 8 <br />
