Attachment to Ordinance 2004-004 <br />That the proposed location of the Restaurant, Full-Service or Cafe and the proposed <br />conditions under which it would be operated or maintained will be consistent with the <br />General Plan; will not be detrimental to the public health, safety or welfare of persons <br />residing, or working in, or adjacent to, the neighborhood of such use; and will not be <br />detrimental to properties or improvements in the vicinity, or to the general welfare of <br />the City; <br />3. That the proposed Restaurant, Full-Service or Cafe will not create adverse impacts on <br />traffic, including but not limited to on-street parking demand, or create demands <br />exceeding the capacity of public services and facilities which cannot be mitigated <br />H. Fast Food Establishments. Small Scale in the CC ar~d-OB <br />Districts, are subject to Administrative Review if the proposal is to establish or enlarge a <br />Fast Food Establishment, Small Scale within five <br />hundred (500) feet of a Residential District. Zoning permit review pursuant to Article 21 shall <br />include but is not limited to a review of the proposal's generation of parking demand, hours <br />of operation, and signage. In order to assure consistency with the purpose of the applicable <br />Commercial District, the Zoning Enforcement Official may impose conditions to limit hours of <br />operations and signage further than what is prescribed elsewhere in this Code. The <br />standard for approval is the Zoning Enforcement Official's ability to make the required <br />findings, as listed below: <br />1. That the proposed location and operation of the , <br />Fast Food Establishment, Small Scale is in accord with the provisions of this code, <br />and the purposes and specific standards of the C Commercial District in which the <br />site is located; <br />2. That the proposed location of the ~„' c^ '~ Fwst ro_a Doc+n~ iron+ Fast Food <br />Establishment, Small Scale, and the proposed conditions under which it would be <br />operated or maintained will be consistent with the General Plan; will not be detrimental <br />to the public health, safety, or welfare of persons residing, or working in, or adjacent <br />to, the neighborhood of such use; and will not be detrimental to properties or <br />improvements in the vicinity, or to the general welfare of the City; <br />That the proposed Smd" cr-~-F~^}~^~-Re°te::re.^.t, Fast Food Establishment, <br />Small Scale will not create adverse impacts on traffic, including but not limited to on- <br />street parking demand, or create demands exceeding the capacity of public services <br />and facilities which cannot be mitigated. <br />Text Amendments to Zoning Code Article 7 <br />2-704 IL District -Use Regulations <br />B.
