All landscaping shall be maintained in a healthy and growing condition at all times. <br />Any damaged or dead plant material shall be promptly replaced with a plant <br />material similar in type and comparable in size to the plant(s) being removed. <br />IV. MAINTENANCE <br />A. The project site shall be well maintained and shall be kept free of litter and debris at <br />all times. <br />B. Any graffiti shall be promptly removed from building walls, windows or doors. <br />V. GENERAL REQUIREMENTS <br />A. All transfer of vehicles to and from the subject site shall be routed via Polvorosa <br />Drive rather than via Williams Street. The applicant shall be responsible for <br />informing those in the employee of transferring vehicles of this requirement. <br />B. Applicant shall advise transporters to schedule deliver and pickup on weekdays <br />only and after 8 a.m. and before 5 p.m. All pickup and delivery by vehicle carrier <br />shall be limited to the Transport Carrier Unloading Area marked on Exhibit B. <br />Applicant shall use commercially reasonable efforts to ensure that the transporters <br />comply with said restrictions. <br />C. The approvals granted by the City as a result of this application, as well as the <br />Conditions of Approval, shall be recorded in the office of the County Recorder of <br />Alameda County. <br />D. No application for amendment of the application or Conditions of Approval may be <br />submitted or accepted for processing by the City unless (i) there is full compliance <br />with all terms of the application and Conditions of Approval; or (ii) the <br />Development Services Director waives compliance with the terms of the application <br />and Conditions of Approval pending application for amendment. <br />E. Pursuant to Zoning Code Section 5-2218, this approval shall lapse on November <br />16, 2007, unless a) a business license has been issued, coupled with diligent <br />progress evidencing a good faith intent to commence the intended use, or b) a <br />written request for aone-year extension of the use permit is approved by the Zoning <br />Enforcement Official. <br />Agreement to Conditions November ] 6, 2006 <br />PLN2006-00085 Page 4 of 4 <br />
