~. <br />The existing chain link/slat fencing shall be removed. The minimum size for new <br />shrub planting shall be five gallons and the minimum size for the ground cover shall <br />be one-gallon or from flats with the necessary spacing to cover the planter areas in a <br />growing season. Pursuant to Article 16 of the Zoning Code pertaining to fencing in <br />the RO Residential Outer District, the maximum height of fencing on the property <br />shall be six feet except in the required 20-foot front yard setback where the <br />maximum height shall not exceed three feet tall. <br />F. Responsibility for maintenance of the fence, including graffiti removal, shall be the <br />sole responsibility of the homeowner's association for this property, which shall be <br />included in the CC&R's. <br />III. ENGINEERING REQUIREMENTS <br />B. The proposed development shall comply with City ordinances, policies and <br />regulations. All improvements shall be in accordance with the City's Design <br />Standards, Specifications and Standard Plans unless otherwise specifically approved <br />by the City Engineer. <br />C. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), the <br />City HEREBY NOTIFIES the applicant for this Project that the 90-day approval <br />period (in which the applicant may protest the imposition of any fees, dedications, <br />reservations, or other exactions imposed on this Project by these Conditions of <br />Approval) will begin on the date of the conditional approval of this Project. If you <br />fail to file a protest within this 90-day period, complying with all of the <br />reQuirements of Government Code Section 66020, you will be legally barred from <br />later challenging any such fees, dedications, reservations or other exactions. <br />D. To create condominiums the Applicant shall submit a Parcel Map for approval by <br />the City Council following approval of these Conditions of Approval. <br />E. Public Utility Easements shall be provided over the private driveway to serve the <br />site. <br />F. The proposed Conditions, Covenants, and Restrictions (CC&R's) for the project <br />shall be approved by the City prior to approval of the Parcel map. <br />II. FIRE DEPARTMENT <br />The driveway to the two-family building at the rear is a required fire access road and <br />parking in that area is not permitted. Markings shall be placed on adjacent curbs <br />indicating the fire lane and/or markings on the driveway, indicating "No Parking". <br />This restriction shall be appropriately noted in the CC&R's. <br />III.
