H. The applicant shall provide some type of mechanical ventilation for all living <br />spaces. Specifics on the mechanical ventilation shall be submitted for review and <br />approval by the Chief Building Official prior to issuance of building permits for <br />each unit. <br />L Unshielded entry doors having a direct or side orientation toward the primary noise <br />source must be 1-5/8 inch or 1-3/4 inch thick, insulated metal or solid-core wood <br />constriction with effective weather seals around the full perimeter. Mail slots shall <br />not be used in these doors or in the wall of anoise-sensitive space, as a significant <br />noise leakage can occur through them. Said walls and doors shall be noted on the <br />building plans submitted, and shall be reviewed and approved by the Chief Building <br />Official prior to issuance of building permits. <br />J. Any penetrations in the building shell required for vents, piping, conduit, etc., shall <br />be controlled by sealing all cracks and clearance spaces with anon-hardening <br />caulking compound, so as to prevent sound leakage around these penetrations. In <br />addition, fireplaces shall be fitted with tight fitting dampers. Said penetrations and <br />method(s) to prevent sound leakage, and fireplace dampers shall be noted on the <br />building plans submitted, and shall be reviewed and approved by the Chief Building <br />Official prior to issuance of building permits. <br />K. In the event that archaeological resources, prehistoric or historic artifacts are <br />discovered during any construction or excavation, the following procedures shall be <br />followed: Construction and/or excavation activities shall cease immediately and the <br />Community Development Department shall be notified. A qualified archaeologist <br />shall be consulted to determine whether any such materials are significant prior to <br />resuming ground breaking construction activities. Standardized procedures for <br />evaluating accidental finds and discovery of human remains shall be followed as <br />prescribed in Sections 15064.5 and 15126.4 of the California Environmental Quality <br />Act. <br />L. Prior to approval of Final Map, the developer shall submit a plan identifying the <br />financial responsibility for complying with each mitigation measure and <br />identifying the methods with which each measure will be implemented and shall <br />post a bond or other acceptable security ensuring the implementation of all <br />mitigation measures. To the extent that the City or any other governmental agency <br />is responsible for supervising or implementing any of the mitigation measures <br />specified in the Mitigation Monitoring Plan, the City or the governmental agency <br />shall charge the applicant for actual costs incurred. As regards the City, the <br />charge for actual costs may be based upon the standard fee schedule for such <br />purposes. Should the City or other governmental agency be unable to sufficiently <br />staff such responsibilities it may, at its discretion, retain outside services which <br />shall be paid for by the developer based upon invoices received. <br />Agreement to Conditions July 18, 2005 <br />PLN2005-00049 Page 8 of 17 <br />
