IL PERMITTED USE <br />A. This Planned Development and Vesting Tentative Map is an approval to construct <br />a nine-unit residential townhouse subdivision on approximately 0.54 acre at the <br />1103 Davis Street (dual-corner parcel on Davis Street at Pacific and Wayne <br />Avenues); Alameda County Assessor's Parcel Number 75-120-61-4. <br />B. No application for amendment of the application or Conditions of Approval may <br />be submitted or accepted for processing by the city unless (i) there is full <br />compliance with all terms of the application and Conditions of Approval; or (ii) <br />the Community Development Director can waive compliance with the terms of the <br />application if they are minor in content. <br />C. Construction of the project shall remain in substantial compliance with the <br />approved exhibits and plans. Any change to the project design, materials or colors <br />shall be subject to the review and approval of the Community Development <br />Director who may administratively approve minor changes, or for more <br />substantial changes, require review by the Planning Commission and City Council <br />as a modification to the Planned Development. <br />D. The ground floor of each unit contains a flexible space for use as a home business <br />or additional living area. Said home businesses in the ground floor units shall be <br />governed by the City of San Leandro Zoning Code Section 2-514, related to Home <br />Occupations -Required Conditions. Home occupations shall comply with the <br />following regulations: <br />1. No one other than a resident of the dwelling shall be employed on site or <br />report to work at the site in the conduct of a home occupation. This prohibition <br />also applies to independent contractors. <br />2. There shall be no interior or exterior activity related to the home occupation <br />inconsistent with or interfering with residential use of the property or <br />detrimental to property in the vicinity. <br />3. A home occupation shall be conducted entirely within a building and shall <br />occupy no more than the lesser of five hundred (500) square feet or twenty- <br />five percent (25%) of the floor area. No outdoor storage of materials or <br />supplies shall be permitted in conjunction with the home occupation. <br />4. The existence of a home occupation shall not be apparent beyond the <br />boundaries of the site, and no home occupation shall involve the use of a sign. <br />5. A home occupation shall comply with the performance standards prescribed <br />by Section 4-1670, provided that no noise shall be perceptible at or beyond the <br />property line. <br />6. A home occupation shall not create pedestrian, automobile, or truck traffic <br />detrimental to property in the vicinity.
