site at the 635/641 MacArthur Boulevard (two parcels on the corner of MacArthur <br />Boulevard and Superior Avenue); Alameda County Assessor's Parcel Numbers 76-328-1 <br />and 76-328-2-1. <br />B. No application for amendment of the application or Conditions of Approval may be <br />submitted or accepted for processing by the city unless (i) there is full compliance with all <br />terms of the application and Conditions of Approval; or (ii) the Community Development <br />Director can waive compliance with the terms of the application if they are minor in content. <br />C. Construction of the project shall remain in substantial compliance with the approved <br />exhibits and plans. Any change to the project design, materials or colors shall be subject to <br />the review and approval of the Community Development Director who may <br />administratively approve minor changes, or for more substantial changes, require review by <br />the Planning Commission and City Council as a modification to the Planned Development. <br />III. ADDITIONAL PLAN SUBMITTALS <br />A. Prior to approval of Final Map, the developer shall submit final landscape and irrigation <br />plans for the review and approval of the Community Development Director. The plans <br />shall include such details as, 1) tree size, species and location; 2) shrubs and groundcovers; <br />3) installation specifications; 4) irrigation details; 5) water conservation techniques; and 6) <br />maintenance programs. To reduce on-site water consumption and reduce the energy <br />required for the pumping and distribution of water, drought-resistant native species shall be <br />used for site landscaping where possible. In addition, the landscape plan shall include tree <br />planting in the rear yards of the northerly townhouse parcels. The locations, species and <br />sizes shall also be subject to the review and approval of the Community Development <br />Director. <br />B. Prior to approval of Final Map, the developer shall submit final plans and details for all the <br />perimeter soundwalls and all fencing for the review and approval of the Community <br />Development Director. The plans and details shall show location, height, decorative <br />features, and construction details showing materials and finishes to be used for <br />construction. All necessary permits or approvals shall be obtained to construct said walls, <br />especially in the case of the soundwall to be constructed at the northerly and westerly edges <br />of the site, which shall be a masonry wall with a minimum of eight feet in height. On the <br />westerly edge of the site, said soundwall shall not exceed three-feet in eight within the 10- <br />foot side yard setback to eliminate sight distance obstruction. <br />C. Prior to issuance of building permits, design details for the dwellings shall be submitted for <br />review and approval of Community Development Director to ensure the quality of the <br />exterior design. Specifically, the final exterior elevation's details and specifications, <br />including but not limited to the selected windows, window sills, raised trim, wood railing <br />for balconies, entry doors, and garage doors shall be submitted to the Community <br />Development Director for review and approval. Said elevations shall specify the use of <br />Hardi-Plank, or a cementatious siding material equivalent, for the specified "wood siding" <br />and shall show enhanced architectural treatment for the south elevation of Unit 7, <br />including, but not limited to, a trellis entry treatment and fenestration for the exterior wall <br />Agreement to Conditions September 6, 2005 <br />PLN2005-00065 Page 4 of 12 <br />
