E. There shall be no display or sales of merchandise outside the building. Any future proposal <br />for outdoor seating would require application for an Outdoor Facilities Permit, subject to the <br />review and approval by the Community Development Department. <br />F. This approval does not include building signage. Signage details shall be submitted for <br />building permits, subject to the review and approval of the Community Development <br />Director. Permitted signage includes individual letters on the front (north) and/or side (east) <br />of the building; no signage is permitted on the rear (south) of the building. Interior window <br />signage shall not exceed 25% of window space, in conformance with Zoning Code, Article <br />18. <br />III. ENGINEERING DEPARTMENT <br />A. The proposed development shall comply with City ordinances, policies and regulations. All <br />improvements shall be in accordance with the City's Design Standards, Specifications and <br />Standard Plans unless otherwise specifically approved by the City Engineer. <br />B. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), the City <br />HEREBY NOTIFIES the applicant for this Project that the 90-day approval period (in which <br />the applicant may protest the imposition of any fees, dedications, reservations, or other <br />exactions imposed on this Project by these Conditions of Approval) will begin on the date of <br />the conditional approval of this Project. If you fail to file a protest within this 90-day period, <br />complying with all of the requirements of Government Code Section 66020, you will be <br />legally barred from later challenging any such fees, dedications, reservations or other <br />exactions. <br />C. Prior to the issuance of building permits for the project, the applicant shall obtain an <br />Encroachment Permit from the Engineering and Transportation Department for any work <br />within the public right-of--way. <br />D. Prior to the issuance of building permits for the project, the applicant shall pay Development <br />Fee for Street Improvement (DFSI) for the proposed restaurant. A credit will be applied <br />for the previously paid fee at the rate of General Retail. <br />E. Prior to occupancy, the owner shall repair any damaged sidewalk, curb and gutter including <br />that damaged during the construction along the project frontage to the satisfaction of the City <br />Engineer. <br />F, The Urban Runoff Clean Water Program requires that all runoff be treated to remove <br />sediment and water borne pollutants prior to discharge into a public facility. Examples of <br />control measures include, but are not limited to: routing of pavement and roof runoff through <br />vegetated swales, vegetated filter strips or landscaped areas in lieu of direct hydraulic <br />connection to the storm drain system; structural control measures, such as oiUwater <br />separator(s), sand filter(s), fossil filter(s) or other methods that may be proposed by the <br />applicant and approved by the City Engineer to intercept and pretreat storm water prior to <br />discharging to the storm drain system; and/or other Best Management Practices that the <br />Agreement to Conditions October 19, 2005 <br />PLN2005-00088 Page 4 of 8 <br />
