In addition, the hallway and pass-through connection from the existing home to <br />the proposed addition shown on Exhibit C -Proposed First- and Second-Floor <br />Plans shall remain open and unobstructed to maintain one single-family dwelling, <br />and not two independent living spaces within the structure. <br />G. The two trees along the Thoits Street side shall be retained and maintained in a <br />mature, healthy growing condition at all times. Appropriate pruning practices shall <br />be performed on the trees such as thinning the trees' canopies. Head (pruning) cuts <br />shall not be performed on the trees. Poor health or death of the trees shall require its <br />replacement with a tree having a minimum size of 24-inch box to the satisfaction of <br />the Zoning Enforcement Official. <br />H. Raised foam (polystyrene) and stuccoed finished trim shall be constructed on the <br />existing windows to match the new raised foam and stuccoed trim on the two-story <br />addition, to the satisfaction of the Zoning Enforcement Official. <br />I. Horizontal wood siding shall be constructed on the two end gables of the two-story <br />addition to match the end gable of the existing home facing Thoits Street, to the <br />satisfaction of the Zoning Enforcement Official. <br />II. GENERAL CONDITIONS <br />A. All structures shall be structurally sound and well-maintained at all times; any <br />damage to the structures shall be promptly repaired. <br />B. Any graffiti on the property shall be promptly removed. <br />C. Any fencing on the property shall conform to Zoning Code Section 4-1682 A. <br />Specifically; the maximum height of a fence, wall, or hedge shall be seven feet <br />except in required front or corner side yards abutting a street where the maximum <br />height shall be three feet tall. <br />D. Construction activity shall not commence prior to 7:00 a.m. and shall cease by <br />7:00 p.m. Monday through Friday, and construction activity shall not commence <br />prior to 8:00 a.m. and shall cease by 7:00 p.m. on Sunday and Saturday. No such <br />construction is permitted on Federal holidays. As provided in this City of San <br />Leandro's Noise Ordinance (ORDINANCE NO. 2003 005), "construction" shall <br />mean any site preparation, assembly, erection, substantial repair, alteration, <br />demolition or similar action, for or on any private property, public or private right- <br />of-way, streets, structures, utilities, facilities, or other similar property. <br />Construction activities carried on in violation of this Article may be enforced as <br />provided in Section 4-11-1130, and may also be enforced by issuance of a stop <br />work order and/or revocation of any or all permits issued for such construction <br />activity. <br />Agreement to Conditions October 4, 2005 <br />PLN2005-00095 Page 4 of 5 <br />
