4. All landscaping improvements shall be maintained in a healthy growing condition at <br />all times. The landscaped areas shall be irrigated by an automatic sprinkler system <br />designed to reduce water usage. The type, nature and amount of landscaping shall <br />conform to the approved final landscape and imgation plan at all times. <br />C. PAVING <br />1. Prior to issuance of building permits, the applicant shall submit final details and <br />specifications and/or a sample of the proposed seeded exposed aggregate paving <br />and the concrete paving at the rear of the property for the project for the review <br />and approval of the Community Development Director and City Engineer. The <br />paving in the front yard setback and the side yards setbacks (i.e., driveways, <br />walkways) shall be seeded exposed aggregate. Said final details and specifications <br />of the proposed paving includes but is not limited to the color(s) and size of the <br />aggregate and the color and finish of the concrete to be used without the exposed <br />aggregate finish. <br />IV. ENGINEERING AND TRANSPORTATION DEPARTMENT <br />A. The proposed development shall comply with City ordinances, policies and regulations. <br />All improvements shall be in accordance with the City's Design Standards, <br />Specifications and Standard Plans unless otherwise specifically approved by the City <br />Engineer. <br />B. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), the City <br />HEREBY NOTIFIES the applicant for this Project that the 90-day approval period (in <br />which the applicant may protest the imposition of any fees, dedications, reservations, or <br />other exactions imposed on this Project by these Conditions of Approval) will begin on <br />the date of the conditional approval of this Project. If you fail to file a protest within this <br />90-day period, complying with all of the requirements of Government Code Section <br />66020, you will be legally barred from later challenging any such fees, dedications, <br />reservations or other exactions. <br />C. Prior to issuance of the Certificate of Occupancy, the applicant shall obtain approval of <br />a Subdivision Map to create a condominium lot. The Subdivision Map shall be <br />approved by the City Council and recorded with the County Recorder's Office. In the <br />event the property owner decides not to create a condominium lot, the property owner <br />shall request in writing to the Community Development Director the termination of this <br />conditional use permit for a condominium so as to facilitate issuance of building permit <br />to construct atwo-story additional dwelling unit to the existing singe-story dwelling on <br />the parcel per Article 5 of the City of San Leandro Zoning Code. <br />D. Prior to approval of the Subdivision Map for the project, the Subdivider shall submit <br />five sets of the Conditions, Covenants and Restrictions (CC&Rs) for the review and <br />approval of the City of San Leandro. The CC&Rs shall specify responsibilities of the <br />Homeowners' Association with respect to maintenance of the common property, <br />structures on the property, landscaping, on-site fencing and perimeter fencing. <br />Agreement to Conditions January 19, 2006 <br />PLN2005-00126 Page 5 of 9 <br />
