CONDITIONS OF APPROVAL <br />PLN2005-00139 <br />765 Marina Boulevard <br />George Assoun (applicant) <br />Anthony A. Batarse, Jr. for <br />Batarse Family Trust (property owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant shall comply with Exhibits A through G, dated January 5, 2006 <br />except as hereinafter modified. (Exhibits are on file at the City of San Leandro <br />Community Development Department, 835 East 14th Street, San Leandro, <br />California). <br />Exhibit A -Site Plan <br />Exhibit B - G -Photo Simulations for Building Signage <br />B. The applicant shall be responsible for assuring that any successor in interest who <br />assumes responsibility for the zoning approval is informed of its terms and <br />conditions. <br />II. USE RESTRICTIONS <br />A. This conditional use approval permits used vehicle sales and a limited auto repair <br />facility to be located at 765 Marina Boulevard (Assessor's Parcel Number 75-93-1- <br />28). These uses are allowed only in conjunction with an associated new car <br />dealership located on Marina Boulevard (in this case, the dealership at 1152 Marina <br />Boulevard). In addition, the indoor display for the western space shall be exclusively <br />for Hyundai and Kia vehicles. Hours of operation shall be Monday-Sunday, 7 AM <br />to 7 PM. Any change in the proposed hours shall require written notification to the <br />Community Development Director a minimum of 30 days prior to the proposed <br />change. The Community Development Director may approve the change in hours <br />administratively or refer the matter to the Board of Zoning Adjustments for <br />consideration. <br />III. BUILDING DIVISION CONDITIONS <br />A. Prior to installation, construction documents shall be submitted for review and <br />approval to the City Building Safety and Services Division for the necessary <br />building permits for the installation of hydraulic lifts proposed for the auto repair <br />facility.
