CONDITIONS OF APPROVAL PLN2005-00139 765 Marina Boulevard George Assoun (applicant) Anthony A. Batarse, Jr. for Batarse Family Trust (property owner) I. COMPLIANCE WITH APPROVED PLANS A. The applicant shall comply with Exhibits A through G, dated January 5, 2006 except as hereinafter modified. (Exhibits are on file at the City of San Leandro Community Development Department, 835 East 14th Street, San Leandro, California). Exhibit A -Site Plan Exhibit B - G -Photo Simulations for Building Signage B. The applicant shall be responsible for assuring that any successor in interest who assumes responsibility for the zoning approval is informed of its terms and conditions. II. USE RESTRICTIONS A. This conditional use approval permits used vehicle sales and a limited auto repair facility to be located at 765 Marina Boulevard (Assessor's Parcel Number 75-93-1- 28). These uses are allowed only in conjunction with an associated new car dealership located on Marina Boulevard (in this case, the dealership at 1152 Marina Boulevard). In addition, the indoor display for the western space shall be exclusively for Hyundai and Kia vehicles. Hours of operation shall be Monday-Sunday, 7 AM to 7 PM. Any change in the proposed hours shall require written notification to the Community Development Director a minimum of 30 days prior to the proposed change. The Community Development Director may approve the change in hours administratively or refer the matter to the Board of Zoning Adjustments for consideration. III. BUILDING DIVISION CONDITIONS A. Prior to installation, construction documents shall be submitted for review and approval to the City Building Safety and Services Division for the necessary building permits for the installation of hydraulic lifts proposed for the auto repair facility.
