CONDITIONS OF APPROVAL <br />PLN2006-00022 - 555-579 Floresta Boulevard <br />(Pak N Save, dd's Discount, Bally's Fitness Shopping Center) <br />Fong Lo (Applicant and Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant and/or property owner shall comply with Exhibit A, dated April 20, 2006, <br />except as hereinafter modified. (Exhibit is on file at the City of San Leandro, <br />Community Development Department, 835 East 14th Street, San Leandro, California). <br />Exhibit A-Site Plan and Off-street Parking Table <br />B. The applicant and/or property owner shall be responsible for assuring that any successor <br />in interest who assumes responsibility for this zoning approval is informed of its terms <br />and conditions. <br />IL USE RESTRICTIONS <br />A. This use permit approves the Modification of Use Permit for Reduced Off-Street <br />Parking (PLN2004-00093). This use permit approves approximately 672 off-street <br />parking spaces for the existing shopping center where 819 parking spaces would be <br />required if the 9,000 square foot building is fully occupied by full-service restaurants, <br />cafes or juice bars. This would modify the previous use permit approval in December <br />2004 (PLN2004-00093) which was approved to provide approximately 672 off-street <br />parking spaces for the existing shopping center where 774 parking spaces were <br />required. The previous use permit was based on the new 9,000 square foot speculative <br />commerciaUretail building at the southwesterly corner (Floresta and Fremont corner) <br />of the shopping center property to be tenanted with uses averaging a parking <br />requirement of one space per 200 square feet. The modification allows the new <br />building to be approved for parking of food uses such as restaurants, cafes, and juice <br />bars which are permitted. These uses require double the parking spaces required far <br />the retail uses (1 space per 100 square feet versus 1 space per 200 square feet; 555- <br />579 Floresta Boulevard (Pak N Save, dd's Discount, Bally's Fitness Shopping <br />Center); also known as Alameda County Assessor's Parcel Number 77B-1163-11-2. <br />B. No fast-food restaurants shall be permitted in the 9,000 square foot building at the <br />corner of Floresta Boulevard and Fremont Avenue. Permitted food uses include full- <br />service restaurants, cafes, juice bars, ice cream/frozen yogurt parlors. <br />Agreement to Conditions April 20, 2006 <br />PLN2006-00022 Page 3 of 4 <br />
