C. To comply with the requirement of no fast-food restaurants, these businesses shall <br />operate as afull-service restaurants where at a minimum the restaurant operation shall <br />include the everyday use of the following: <br />1. Flatware (plates). <br />2. Silverware (forks, spoons, knives). <br />3. Table service (although orders maybe placed at the counter, the prepared food <br />shall be brought by a server to the patrons table). <br />4. Automated dishwasher inside the building. <br />5. Operating time shall not extend beyond 10:00 p.m. <br />This condition does not include the incidental use of disposable containers and <br />~?isr~osable tableware for tale-ont orders (foo~? to-go). <br />D. These conditions of approval shall be conspicuously posted inside the new building <br />within the tenant spaces and attached as an addendum to the building leases prior to <br />commencing business operations within any space inside the building. In addition, these <br />conditions shall be made accessible to all employees on the property <br />E. All other conditions of approval to PLN2004-00093 shall remain in full effect. <br />III. GENERAL CONDITIONS <br />A. The approvals granted by the City as a result of this application, as well as the <br />Conditions of Approval, shall be recorded in the office of the County Recorder of <br />Alameda County. <br />B. No application for amendment of the application or Conditions of Approval may be <br />accepted or submitted for processing by the City unless (i) there is full compliance with <br />all terms of the application and Conditions of Approval; or (ii) the Community <br />Development Director waives compliance with the terms of the application and <br />Conditions of Approval pending application for the amendment. <br />Agreement to Conditions April 20, 2006 <br />PLN2006-00022 Page 4 of 4 <br />
