CONDITIONS OF APPROVAL <br />PLN2006-00014 <br />13140 Neptune Drive <br />J. Chen (Applicant and Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The project shall comply with Exhibits A through H, dated Apri120, 2006 except as <br />hereinafter modified. (Exhibits are on file at the City of San Leandro, Community <br />Development Department, 835 East 14th Street, San Leandro, California, 94577). <br />Exhibit A -Revised Site Plan & Adj acent Dwellings Footprints <br />Exhibit B -First and Second Floor Plans Unit B & C <br />Exhibit C -Revised First and Second Floor Plans Unit A <br />Exhibit D -Elevations, Two-Family Dwelling (Unit B & C) <br />Exhibit E -Revised Front and Rear Elevations, Unit A <br />Exhibit F -Revised Side Elevations, Unit A <br />Exhibit G - Streetscape <br />Exhibit H -Garage Door Example <br />B. The applicant shall be responsible for assuring that any successor in interest who <br />assumes responsibility for this zoning approval is informed of its terms and <br />conditions. <br />C. Construction shall commence within one (1) year following the Board of Zoning <br />Adjustments approval of the Conditional Use Permit and the Site Plan Review <br />and shall be substantially completed one year after commencement of <br />construction. For the purpose of compliance with this condition, commencement <br />of construction shall be defined as the pouring or construction of a substantial <br />portion of the building foundation structures. Pursuant to Zoning Code Section 5- <br />2218, this approval shall lapse on April 20, 2007 unless a) a building permit has <br />been issued, coupled with diligent progress evidencing good faith intent to <br />commence the intended use, or b) a written request for aone-year extension of the <br />use permit is approved by the Zoning Enforcement Official. <br />II. PERMITTED USES <br />A. This Conditional Use Permit is an approval to convert one existing single-family <br />home and one proposed two-family home into a condominium for sale as three <br />individual units at 13140 Neptune Drive, also known as Alameda County Assessor's <br />Parcel Number 79A-565-41. In addition, this Site Plan Review approves a second <br />story addition to the existing single-family home and construction of an additional <br />two-story, two-family residence at the rear of the property known as 13140 <br />Neptune Drive. <br />
