CONDITIONS OF APPROVAL <br />PLN2006-00036 -15009 Farnsworth Street; <br />Schelly's Bay Area Bars Inc. (Applicant), L. Fingerut (Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant and/or property owner shall comply with Exhibits A and B, dated <br />May 18 2006, except as hereinafter modified. (A copy of Exhibits A and B is on <br />file in the Community Development Department, 835 East 14th Street, San <br />Leandro, California). <br />Exhibit A -Site Plan <br />Exhibit B -Floor Plan <br />B. The applicant and/or property owner shall be responsible far assuring that any <br />successor in interest who assumes responsibility for this zoning approval is <br />informed of its terms and conditions. <br />II. PERMITTED USE <br />A. This approval is for a conditional use permit to provide live entertainment <br />activities, specifically karaoke, live music and comedy acts inside Schelly's. The <br />live entertainment activities shall be limited to the hours of 9 p.m. to 1 a.m., <br />Wednesday to Saturdays, and from 1 p.m. to 6 p.m. on Sundays; 15009 Farnsworth <br />Street; Alameda County Assessor's Parcel Number 80G-1374-2-5. <br />B. Dancing is strictly prohibited. Signs stating `~To Dancing" shall be posted <br />throughout the establishment. (Dancing and serving of alcohol at the same <br />location constitutes a Dance Hall per San Leandro Municipal Code Section 4-4- <br />100 and the Zoning Code. Dance Halls are not permitted, conditionally or <br />otherwise, in the CN Commercial Neighborhood District). <br />C. All karaoke, live music and comedy acts shall be performed indoors, in the area <br />designated in Exhibit B -Floor Plan, and with doors and windows closed. <br />D. The applicant shall install signage inside the building, near the doors, reminding <br />patrons that the doors are to remain closed when live entertainment activities are <br />occurring. <br />E. The live entertainment will be subject to a mandatory staff review within six <br />months of this Conditional Use approval to determine if noise, loitering, vehicular <br />parking or any other impacts are disturbing the surrounding properties. Should <br />there be complaints regarding noise or loitering the Community Development <br />Director shall review the issue(s) and recommend mitigation measures and /or refer <br />the matter back to the Board of Zoning Adjustments for consideration. Measures for <br />noise mitigation could include further restricting the hours of the live entertainment <br />and/or soundproofing or insulation in the building. <br />
