` F. The area used for the entertainment activities shall be limited to the approximately <br />' 80 square-foot space at the front of the building, as shown on Exhibit B. The <br />applicant and/or property owner shall make a request in writing to the Community <br />Development Director for any expansion of the area devoted to the live <br />entertainment. Uses other than karaoke, small live bands, and comedy acts, or a <br />change in the days/hours of such uses would also be considered an expansion. <br />Upon receiving the request, the Community Development Director may approve it <br />administratively or refer the matter to the Board of Zoning Adjustments for its <br />consideration at a public hearing. <br />G. The applicant shall provide personnel to police the site on each day and during the <br />normal business hours of 7 a.m. to 2 a.m. for the purpose of preventing or abating <br />any excessive noise generated by patrons or persons loitering outside the building. <br />H. No temporary exterior signage advertising live music events shall be allowed <br />unless otherwise approved by a special event permit approved by the City. <br />III. FIRE DEPARTMENT <br />A. All building and fire code requirements for exits, aisles and occupant loads shall be <br />maintained at all times. The occupant load for this establishment is 103 patrons. <br />IV. MAINTENANCE <br />A. The project site shall be well maintained and shall be kept free of litter and debris at <br />all times. <br />B. Any graffiti shall be promptly removed from building walls and trash enclosure. <br />V. GENERAL REQUIREMENTS <br />A. There shall be no loitering permitted on the site and the site shall be posted to permit <br />enforcement of the City ordinance prohibiting loitering by the City of San Leandro <br />Police Department. <br />B. The approvals granted by the City as a result of this application, as well as the <br />Conditions of Approval, shall be recorded in the office of the County Recorder of <br />Alameda County. <br />C. No application for amendment of the application or Conditions of Approval maybe <br />submitted or accepted for processing by the City unless (i) there is full compliance <br />with all terms of the application and Conditions of Approval; or (ii) the Community <br />Development Director waives compliance with the terms of the application and <br />Conditions of Approval pending application for amendment. <br />D. Pursuant to Zoning Code Section 5-2218, this approval shall lapse on May 18, 2007 <br />unless a) diligent progress evidencing good faith intent to commence the intended <br />use, or b) a written request for aone-year extension of the use permit is approved by <br />the Zoning Enforcement Official prior to the expiration of the use permit. <br />Conditions of Approval May 1 S, 2006 <br />PLN2006-00036 Page 2 of 2 <br />
