requirements of Government Code Section 66020, you will be legally barred from <br />later challenging any such fees, dedications, reservations or other exactions. <br />C. Prior to the issuance of the Building Permit, the property owner shall pay the Park <br />Facilities Development Impact Fee (As of 8/8/02 $3,400 per unit), and <br />Development Fee for Street Improvement (DFS>) (As of 8/8/02 approx. $900 per <br />unit), Sewer Connection fee and other fees as required by City Ordinances and <br />regulations. <br />D. Applicant shall remove any broken and uplifted sidewalk, curb and gutter along the <br />full project frontage and shall construct new City standard sidewalk, curb and gutter <br />in the same location and alignment as the existing curb and gutter. <br />E. Applicant shall provide 30 feet of paved area for vehicle back-up and maneuvering <br />in front of the garage and parking spaces. <br />F. Prior to the issuance of building permits for the project, the Applicant shall obtain <br />an Encroachment Permit from the Engineering and Transportation Department for <br />any work within the public right-of--way. <br />G. If the design of any site improvements requires encroachments onto neighboring <br />properties during construction, written agreements with that property owner shall <br />be submitted to the City Engineer, for review and approval, prior to issuance of <br />the building permits. <br />H. Construction activity shall not commence prior to 7:00 a.m. and shall cease by 7:00 <br />p.m.; Monday through Saturday, unless otherwise approved in writing by the City <br />Engineer. There shall be no construction activity on Sundays or City, federal, or <br />state holidays. <br />IV. CONSTRUCTION PROVISIONS <br />A. Construction activity shall not create dust, noise, or safety hazards for adjacent <br />properties. Dirt and mud shall not be tracked onto public right-of--way from the <br />project site. <br />V. FENCING AND SCREENING REQUIREMENTS <br />A. All fencing shall be structurally sound and well maintained at all times. <br />B. No barbed or ribbon wire shall be installed on the fences. <br />C. The fence separating 1374 Pacific Avenue and 1386 Pacific Avenue shall not be <br />taller than three feet in the first 20 feet of the property. After that point, the fence <br />may be as tall as seven feet, but the height shall be a consistent height and a <br />consistent appearance for the entire length of the property. <br />Agreement to Conditions May 1, 2003 <br />PLN2003-00012 Page 4 of 6 <br />
