VIII. MAINTENANCE <br />A. The site shall be well maintained and shall be kept free of litter, debris and weeds. <br />B. Trash and recycling shall be kept within appropriate receptacles and the receptacles <br />kept within the trash enclosure at all times. The trash enclosure on the site shall be <br />used and maintained closed at all times. Garbage and recycling pick up by the <br />disposal company shall be maintained at a frequency to prevent the bins from <br />overflowing at any time. <br />C. The signage shall be kept in a good, clean, sound condition at all times; any damage <br />to the signs shall be promptly repaired. <br />D. Any graffiti shall be removed from the building walls and the perimeter fencing. <br />E. The applicant shall be responsible for litter pick up of patron's litter twice a day for <br />a minimum distance of 400 feet from the exterior property lines. Identifiable <br />containers and napkins shall be used for carry-out food, and litter resulting shall be <br />promptly picked-up and removed. Six (6) months after completing the drive-thru <br />and building renovation project on the site, if the Zoning Enforcement Official <br />determines that a litter problem still exists, the applicant shall retain a contract litter <br />clean-up service for one of two daily pick up services required by this condition. <br />IX. CONSTRUCTION PROVISIONS <br />A. Construction on the project site shall not commence prior to 7:00 a.m. and shall <br />cease by 7:00 p.m., Monday through Friday, and shall not start prior to 8 a.m. and <br />shall cease by 7 p.m. Saturday and Sunday, unless otherwise approved by the <br />Chief Building Official. There shall be no construction on Federal holidays. <br />Interior construction such as sheet rock taping and texturing, painting, file <br />installation and similar activity shall be permitted outside the above hours <br />provided that construction noise shall not be detectable outside of the structures <br />being built. <br />B. Construction activity shall not create dust, noise or safety hazards for adjacent <br />residents and properties. Dirt and mud shall not be tracked onto Lillian and East <br />14th Streets from the project site during construction. <br />C. Dust generating activities such as grading, excavation, paving etc., shall be <br />scheduled the early morning and other hours when wind speeds are low. All <br />construction activities entailing soil disturbance shall cease when winds exceed 30 <br />miles per hour as an hourly average. <br />D. Procedures with the highest noise potential shall be scheduled for daylight hours, <br />when ambient noise levels are highest. <br />Agreement to Conditions May 17, 2007 <br />PLN2007-00009 Page 6 of 7 <br />
