The property owner shall comply with Exhibits A through G, attached to the staff <br />report dated May 17, 2007, except as hereinafter modified. The applicant and/or property owner shall be responsible for assuring that any <br />successor in interest who assumes responsibility for this zoning approval is <br />informed of its terms and conditions. Construction shall commence within one (1) <br />year following Board of Zoning Adjustments approval and shall be substantially <br />completed one (1) year thereafter. For the purpose of compliance with this <br />condition, commencement of construction shall be defined as the pouring or <br />construction of a substantial portion of the building foundation. <br />II. PERMITTED USE <br />A. This conditional use permit allows for a second drive-thru lane to be added <br />adjacent to the existing drive-thru lane, and allows for a change in the hours of <br />operation of the restaurant interior to open at 5 a.m. and close by 11 p.m., at <br />McDonald's, 14823 East 14r~' Street. Any change to the site plan or modification <br />of the drive-up facility shall be subject to the review of the Community <br />Development Director, who may approve it administratively or direct it to the <br />Board of Zoning Adjustments for a formal public hearing as a modification to the <br />use permit. <br />B. The hours of the drive-thru facility shall be restricted to opening no earlier than 5 <br />a.m. and closing by no later than 11 pm. Sunday thru Thursday, and by no later <br />than 1 a.m. on Friday and Saturday. Any proposed changes to the hours of <br />operation for either the restaurant or the drive-thru shall be brought back to the <br />Board of Zoning Adjustments for their consideration. <br />Agreement to Conditions May 17, 2007 <br />PLN2007-00009 Page 3 of 7 <br />
