Section 14: Environmental Review.
This Ordinance does not itself approve or allow the construction of any project and,
therefore, has no potential for resulting in a physical change in the environment, directly or
ultimately. Therefore, adoption of this Ordinance is exempt from environmental review under
the California Environmental Quality Act pursuant to Public Resources Code section 21065
based on the finding that this Ordinance is not a "project" within the meaning of Section 1537$
of the State CEQA Guidelines. The adoption of this Ordinance is further exempt from
environmental review pursuant to Section 15305 of the State CEQA Guidelines, because it is a
minor change in land use regulations that will not result in any changes to underlying zoning
standards.
Section 15: Effective Date and Publication.
This ordinance shall take effect thirty (30) days after adoption and the title thereof shall
be published once prior to adoption.
Section lb: Severability.
If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the
ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of
competent jurisdiction, such decision shall not affect the validity or effectiveness ofthe
remaining portions of this Ordinance or any part hereof. The City Council hereby declares that it
would have passed each section of the Ordinance irrespective of the fact that one or more of
them would be declared unconstitutional or invalid. To this end, the provisions of the Ordinance
are declared to be severable.
Introduced by Councilmember
2008, and passed to print by the following called vote:
Members of the Council:
AYES:
NOES:
ABSENT:
ATTEST:
Marian Handa, City Clerk
on this 7t~' day of January,
12
