Easement Vacation/Acceptance -Tract 7382 2 January 7, 2008 <br />within the vicinity of said cul-de-sac are no longer needed. Additionally, various private and <br />public easements within the vicinity of the former cul-de-sac are no longer necessary, and new <br />easements will need to be dedicated for the new cul-de-sac configuration. An EVAE of <br />approximately 930 square feet will be granted to the City of San Leandro (City) to replace the <br />EVAE to be abandoned across new Lot 8; a 10' wide IEE and PUE will be dedicated along the- <br />Business Center Drive frontage of new Lot 7 and 8; and an EVAE, IEE, and PUE will be granted <br />inside the portion of Business Center Drive (Parcel A) that was recently created. <br />Analysis <br />The process of right-of--way summary vacation requires one resolution and no public hearing, <br />and is more cost effective than the longer but more commonly used vacating procedure. The <br />State of California Streets and Highway Code sets the authority and procedures for street, <br />highway, and easement abandonment. The procedure for summary vacation is outlined in Title <br />V, Chapter 4, of the San Leandro Municipal Code and in Part 3, Division 9 of the Streets and <br />Highway Code. <br />Per Chapter ~ of Part 3, Division 9, Section 8333(c) of the Streets and Highway Code, the <br />legislative body of the local agency may summarily vacate a public service easement if the <br />easement has been superseded by relocation and there are no other public facilities located within <br />the easement. There is a water main and a 48" sewer force main that goes through the portion of <br />PUE to be abandoned, but both these items have their own easement. The water line is located <br />within an EBMUD easement, and the sanitary sewer force main is inside an easement dedicated <br />to the East Bay Dischargers Authority. <br />Current City Council Policy <br />Not Applicable <br />Previous City Council Action(s) <br />• On November 4, 2002 by Resolution No. 2002-153, the City Council approved Tentative <br />Map 7382 <br />On March 17, 2003 by Resolution No. 2003-073, the City Council approved the final <br />subdivision map and subdivision improvement agreements (both private and public <br />improvements), and accepted the dedication of public right-of--way and public utility <br />easements for Tract 7382 <br />• On April 2, 2007 by Resolution No. 2007-045, the City Council approved the initial <br />acceptance of subdivision improvement work constructed by Bayside BC, L.P. for nine <br />industrial parcels in Tract 7382 <br />City Council Committee Review and Action <br />Not Applicable <br />
