The proposal will provide an opportunity for ownership of individual units. The conditions <br />of approval will require comprehensive and final physical conditions reports of the property <br />such as foundation, walls, roofing, mechanical equipment, et cetera. The final reports will <br />be required to provide all necessary repairs or upgrades, if any, to bring up to Code and <br />extend the life of the structure(s). Moreover, with the necessary conditions relating to the <br />off-street parking, landscaping, building code compliance, property maintenance, and the <br />creation of CC&R's (Conditions, Covenants and Restrictions), the attractive appearance of <br />the property will be maintained. Conditions of approval address all requirements related to <br />Inclusionary Housing and Condominium Conversion. <br />C. That the proposed use will comply with the provisions of this code, including any <br />specific condition required for the proposed use in the district in which it would be <br />located. <br />Upon conversion, the existing development will remain compatible with existing adjacent <br />development in the immediate area. The development itself conforms to all Planned <br />Development (PD-85-2) standards (i.e., setbacks, coverage, and height) with the exception <br />of the reduction of landscaping in order to increase the amount of off-street parking. <br />Conformance to all other PD-85-2 requirements will maintain adequate availability of light, <br />air and privacy for the development and adjacent properties. <br />D. That the proposed use will not create adverse impacts on traffic or create demands <br />exceeding the capacity of public services and facilities, which cannot be mitigated. <br />Additional on-site parking and adequate access will be provided for the residential <br />development. Conversion of the existing rental apartments to condominium for separate <br />ownership will not increase trip generation from the property. There is adequate public <br />service provided to the existing residential development, including but not limited to the <br />gas and electric, the water, waste disposal, cable TV, and police and fire services <br />E. That all the provisions of the Subdivision Map Act, this Code, and other applicable <br />provisions of the Municipal Code are met. <br />The required tentative map (vesting) and condominium plan to convert the apartment <br />complex into a condominium for individual ownership, and the proposed site improvement <br />plans have been submitted for review of the City per the Subdivision Map Act and the <br />City's Zoning Code and Municipal Code. <br />F. That the proposed conversion is consistent with the General Plan goal of maintaining <br />a reasonable balance of rental and ownership housing, and meets the requirements of <br />the adopted Housing Element and any applicable specific plan. <br />Prior to the application for conversion, the applicant submitted a real estate survey by <br />RealFacts (Real Estate Data Company) of 14 rental properties in the San Leandro area, and <br />the occupancy and vacancy rates. The survey comprised 1,182 residential units not <br />including the Woodside Apartments. The survey reported that the average vacancy rate was <br />5.8 percent.
