4. The HOA shall keep the City informed of the current name, address and phone <br />number of the association's official representative(s). <br />S. The HOA shall be responsible for the appearance and structural integrity of <br />screen walls, pilasters, arbors/trellises along the Haas Avenue frontage of the <br />property. <br />6. The CC&Rs shall include a requirement that deviations to the exterior color of <br />the on-site structures shall be submitted to the City for approval. <br />7. All amendments to the CC&Rs that would add a new use on the property, <br />change the use of the property or create physical change(s) to the property not <br />specified on the approved Planned Development (PD-85-2) shall be reviewed <br />and approved by the City of San Leandro Community Development <br />Department, Engineering and Transportation Department, and the City Attorney <br />prior to recordation. <br />8. All parcels held in common, and all perimeter fences and walls adjacent to a <br />public right-of--way, shall comply with the approved landscape plan. <br />9. Enforcement of the CC&Rs shall be the responsibility of the HOA. <br />G. Prior to the issuance of building permits for the project, the Developer shall obtain <br />an Encroachment Permit from the Engineering and Transportation Department for <br />any work within the public right-of--way. <br />H. Applicant shall remove any broken and uplifted sidewalk, driveway, curb and <br />gutter along the full project frontage and shall construct new City standard <br />sidewalk driveway, curb and gutter in the same location and alignment as the <br />existing curb and gutter. Applicant shall remove any unused driveways and <br />construct new City standard sidewalk, curb and gutter in the same location and <br />alignment as the existing sidewalk, curb and gutter and shall construct City of San <br />Leandro standard commercial driveway approaches. <br />1. The Developer shall be responsible for ensuring that all contractors and <br />subcontractors are aware of and implement all storm water quality measures. Failure <br />to comply with the approved construction BMPs shall result in the issuance of <br />correction notices, citations and/or a project stop order. <br />J. No construction materials and/or equipment shall be stockpiled or parked within the <br />City right-of--way. <br />K.
