E. Applicant shall remove any broken curb and gutter along the full project frontage <br />along Cambridge Avenue, and shall construct new City standard sidewalk, curb and <br />gutter in the same location and alignment as the existing curb and gutter. <br />F. Prior to the issuance of building permits for the project, the Applicant shall obtain <br />an Encroachment Permit from the Engineering and Transportation Department for <br />any work within the public right-of--way of Cambridge Avenue. <br />G. Design review fees, permit fees, inspection fees, and any other fees charged by the <br />City or other reviewing agencies for the review, approval, permitting and inspection <br />of the public improvements shall be paid by the Applicant. <br />IV. FIRE DEPARTMENT <br />A. Prior to issuance of building permits, final construction documents shall be <br />submitted to the San Leandro Building and Safety Services Division and to the <br />Alameda County Fire Department for review and approval. <br />B. Prior to issuance of Certificate of Occupancy, all applicable Fire and Building Cade <br />requirements shall be completed to the satisfaction of the Alameda County Fire <br />Marshall and the City of San Leandro Chief Building Official. <br />V. MAINTENANCE <br />A. The site shall be well maintained and shall be kept free of litter, debris and weeds. <br />B. The fencing on the property shall be structurally sound and well maintained at all <br />times; any damage to the fence shall be promptly repaired. <br />C. Any graffiti shall be removed from the building walls and the perimeter fencing. <br />VL CONSTRUCTION PROVISIONS <br />A. Construction activity shall not create dust, noise, or safety hazards for adjacent <br />properties. Dirt and mud shall not be tracked onto Cambridge Avenue or any <br />nearby streets from the project site. <br />B. Hours of construction shall be limited to the hours of 7 a.m. and 7 p.m. on <br />weekdays, or between 8 a.m. and 7 p.m. on Sunday and Saturday. No such <br />construction is permitted on Federal holidays. As used in this Article, <br />"construction" shall mean any site preparation, assembly, erection, substantial <br />repair, alteration, demolition or similar action, for or on any private property, <br />public or private right-of--way, streets, structures, utilities, facilities, or other <br />similar property. Construction activities carried on in violation of this Article may <br />be enforced as provided in Section 4-1-1130, and may also be enforced by <br />Agreement to Conditions June 6, 2007 <br />PLN2007-00022 Page 5 of 6 <br />
