WHEREAS discussions between the City, BART and Westlake Development Partners, <br />LLC suggested that greater physical and financial flexibility could be achieved by combinng the <br />BART property with the Chang property and the City property (Martinez Street) separating the <br />BART and Chang properties; and <br />WHEREAS it was determined on a preliminary basis that greater development and transit <br />access flexibility could be achieved by combining these properties; and <br />WHEREAS City and Agency staff, San Francisco Bay Area Rapid Transit District (BART), <br />and Westlake Development Partners, LLC have negotiated an Exclusive Negotiating Agreement, <br />under which Westlake Development Partners, LLC would further investigate site conditions and <br />development possibilities, eventually leading to some form of development agreement to be <br />determined, between the City, the Agency and Westlake Development Partners, LLC; and <br />WHEREAS in the interest of insuring broad public participation in a project application that <br />will result from this Exclusive Negotiating Agreement, community groups, labor organizations and <br />various stakeholders will be provided an opportunity to address the following issues, including, but <br />not limited to: <br />• child care and social services, <br />• affordable housing, housing mix and type, <br />• sustainability and green building, <br />• information on impacts to neighborhoods, and <br />• employment generation during construction and at build-out; and <br />WHEREAS the Agency has been presented with the Exclusive Negotiating Agreement and <br />is familiar with the contents thereof; <br />NOW, THEREFORE, the Redevelopment Agency of the City of San Leandro does <br />RESOLVE as follows: <br />That the Exclusive Negotiating Agreement with Bay Area Rapid Transit District (BART) <br />and Westlake Development Partners, LLC is hereby approved, and the Executive Director is <br />authorized to execute it. <br />Introduced by Agency Member Grant and passed and adopted this 4rh day of February, 2008 <br />by the following called vote: <br />RESOLUTION NO. 2008-004 RDA 2 <br />
