Adopted 7116l20~9 _ Eff®~;,,~ 8/15/20p'1 <br />(with emendmer-ts as of January 2006) <br />5.2406 Requirements <br /> <br />City of San Leandro Zoning Code - Article 24 <br />in addifion to the applicable requirements and procedures set forth in Tide VII; Chapter 1 <br />of the San Leandro Municipal Code, conversions of existing rental housing to <br />condominiums, townhouses, community apartments, stock cooperatives, and any other <br />subdivision which is a conversion of existing rental housing shall be subject to the <br />additional requirements of this Code. Such conversions also must obtain a use permit <br />pursuant to Article 22. No person shall cause a conversion of the type herein referred to <br />except in accordance with this Article. <br />5-2408 Application Procedures <br />The. following procedures and regulations shall app-y to cmndominium conversion <br />applications: <br />A. Preliminary r,olicati ns. Applicants may submit to the Community <br />Development Department preliminary applications for condominium <br />conversions of residential structures to condominiums, Such applicatjons <br />shall idenfify the owner or authorized agent, the location end number of <br />units in the building to be converted, and contain information on the <br />vacancy rate of mui~-family dwellings of three (3) or more units within the <br />City and the number of tenants who support such a conversion. <br />Data for determining the City's annual multi-family vacancy rate shall be <br />compiled from a variety of sources including, but not limited to, United <br />States Postal Service Surveys, idle utility meter reports, reports from <br />financial institutions, and real estate organizations, <br />B. De ent ev~gw, The Community Development Department shall <br />review preliminary applications for condominium conversions. Preliminary <br />applications may be aaepted for further discretionary review if any one of <br />th~•fogowin® factors exists: <br />. T.J: <br />1. The vacancy rate of multiple-family developments of three (3) or more <br />rental units within the City, as determined by the Zoning Enforcement <br />Official, Is equal to or more than five percent (6%), unless the <br />conversion will result in a decxease of the vacancy rate to less than <br />five percent (5%), <br />~~ 2._ Tanants law;ully• In' possession of seventy-five, percent (75°fo) of Uie <br />units indicate in writing to the City their desire (one vote per unit) to <br />convert such units to condominium ownership. 7o qualify under this <br />provision, the applicant shall submit evidence that tenants have been <br />Provided with information on all estimated costa, including, but not <br />limited to, the unit cost, down-payment requirements, financing, <br />.
