PERMIT NO. 6-78 <br />City of San Leandro <br />(Issued on May 24, 1978, As <br />Amended Through November 13, 2007) <br />CORRECTED AMENDMENT NO. SEVEN <br />Page 10 <br />Finally Amendment No. Six also modifies language contained in Special Condition <br />II-B-2 of this amended permit, which is intended to ensure that marinas comply with <br />federal and state water quality laws prohibiting the discharge of oily waste, including <br />wastewater, into the Bay. This special condition as originally written, however, resulted <br />in some marina operators prohibiting boat owners from using automatic bilge pumps, <br />which, in turn put owners at risk of losing their boats and insurance. Therefore, Special <br />Condition II-B-2 was revised so as not to apply to the discharge of liquid wastes <br />associated with use of automatic bilge pumps. The modification to this special condition <br />will not result in adverse effects on the Bay, and thus is a similar activity with no greater <br />adverse impact on the Bay, as defined by Commission Regulation Section 10601(e)(3), to <br />those listed as minor repairs or improvements in Commission Regulation Section 10601. <br />Further, this modification will not result in a material alteration of the original <br />authorization, and thus can be authorized by the Executive Director, pursuant to <br />Commission Regulation Section 10822. <br />The work authorized in Amendment No. Six involves routine repairs, reconstruction, <br />replacement, removal and maintenance in the Bay and within the 100-foot shoreline band <br />that do not involve any substantial enlargement or change in use, as defined in Regulation <br />Sections 10601(x)(6), and Regulation Section 10601(b)(5) and the placement of small <br />amounts of inert inorganic fill in the shoreline band that does not have a significant <br />adverse effect on present or possible future maximum feasible public access consistent <br />with the project, as defined in Regulation Section 10601(b)(1), and is therefore a "minor <br />repair or improvement" for which the Executive Director may issue a permit, pursuant to <br />Government Code Section 66632(f) and Regulation Section 10622(x). <br />2. Amendment No. Seven. Amendment No. Seven authorizes the construction and <br />maintenance of a new boat launch ramp, reconfiguring the parking_lot, replacement and <br />construction of a public access walkwaX, and remodel and maintenance of an existine <br />bathroom. Thus, the proiect involves, "minor repairs or improvements" for which the <br />Executive Director may issue a permit, pursuant to Government Sections 66600 through <br />66661, the San Francisco Bay Plan, and Regulation Section 10820, in that the project is, <br />"similar to the activities to those listed in paragraphs (aZ (bZ (c, and (d) of this section <br />that would have no greater adverse impact on the Bay than the listed activities." as stated <br />in Regulation Section 10601(e)(3). <br />Specifically, the placement of material for grading and the boat launch ramp in the Bay is <br />similar to, "installation of new protective works and repairs to existing protective works, <br />such as bulkheads and riprap, that meet the following criteria: ,B) the new work or <br />repairs to exiting_work~s) would cover less than 10,000 square feet of the horizontal <br />projection of the work below the shoreline," as stated in Regulation Section <br />10601 ~)(2)(B). <br />
