Commission Jurisdiction Over Fill Area. Notice is hereby given that, under the McAteer- <br />Petris Act, the area of the approved project that is presently within the Commission's <br />jurisdiction, under Section 66610(a) remain within that jurisdiction even after fill or substantial <br />change in use, authorized by the Commission, may have changed the character of an area; so that <br />the permittee or the permittee's successors in interest will require further permit action by or on <br />behalf of the Commission prior to any future changes of use or work within areas filled pursuant <br />to this authorization. <br />D. Dredging. Dredging is necessary to provide an access channel to the small boat berths, <br />and the disposal of spoils is in accordance with Bay Plan policies in that the spoils will be <br />disposed of at a location outside the Commission's jurisdiction. <br />E. Public Access. The ~~ original project, subject to Special Condition II-C stated <br />herein, ~ provides maximum feasible public access to the Bay shoreline consistent with the <br />original project by providing a public boat launching ramp and a 4,000-square-foot landscaped <br />public access area in addition to an 8-foot-wide by 200-foot-long pedestrian pathway to connect <br />existing access at South Dike Road to the Marina Park at the southern end of the project. <br />Amendment No. Seven authorized herein provides maximum feasible public access to the <br />Bay shoreline consistent with the amended Project b~providing a new public boat launching <br />ramp and a 6 to 13-foot-wide, 224foot-lonerpedestrian pathway to connect to existing access at <br />the project site. <br />F. Amendments <br />1. Amendment No. Six. Amendment No. Six authorizes the removal and replacement of <br />existing fuel lines at the San Leandro Marina. The improvements to the existing fuel <br />system are required to bring the facility into regulatory compliance. Amendment No. Six <br />also authorizes relocating the existing fuel dock approximately 6 feet east of its existing <br />location. Ninety-six square feet of dock extensions will be added onto the existing fuel <br />dock so that the dock can be relocated and attached to existing piles rather than driving <br />new piles. The fuel dock currently rests on Bay mud during low tides and collides with <br />the underside of an adjacent pier at high tides. Relocating the fuel dock will eliminate <br />these issues. <br />Amendment No. Six also authorizes the removal and replacement of 2,075 square feet of <br />decking and guardrails on the existing South Dike Road public access fishing pier. This <br />pier pre-existed the Commission and was not required to be provided for public access. <br />The pier is currently in a state of disrepair and improvements to it will provide an <br />additional public benefit at the project site by providing a safe, usable and accessible <br />location for walking, fishing, and vie-wing the Bay. <br />
