Proposed Kaiser Permanente Memorandum of Understanding and EIR Contract <br />City Manager Jermanis reported that approval of the Kaiser Permanente (KP) Memorandum <br />of Understanding (MOU) and EIR Contract are on the agenda for Monday, September 18. <br />Planning Manager Pollan explained that staff has been working the past three months on a <br />MOU which establishes the framework for KP's entitlement process. The MOU covers <br />roles, timeline, City reimbursement and process for entering into a Development Agreement. <br />Planner Livermore reported that in addition to the MOU, a contract with EIP for $540,000 <br />for development of the Environmental Impact Report (EIR) will be brought to Council on <br />September 18. EIP was selected following an RFP process and lengthy negotiations <br />regarding the scope of the project. KP will reimburse the City for the cost of the EIR. <br />The Committee discussed mitigation to be paid by KP for traffic as well as City services. <br />Assistant City Manager Hollister shared that the City will also be hiring a consultant to <br />perform a separate financial impact analysis. <br />4. Developer Selection for Agency-owned Property at 1595 Washington (EBMUD <br />Building) <br />Business Development Manager Sims reported that this site is included as one of the 39 TOD <br />sites that would be affected by a moratorium. He believes, however, that it wouldn't have a <br />significant affect on the project as a developer could work through the entitlement process up <br />to final approval during the moratorium. <br />Business Development Manager Sims reviewed that the Agency purchased the property from <br />EBMUD with the intention of relocating the Chamber of Commerce to the site. Based on a <br />determination that the site did not work for the Chamber, the Agency requested proposals <br />and has been discussing possible development with two developers. Both developers <br />understand and are willing to work through the TOD process, which might benefit them by <br />allowing higher density and lower parking requirements. Once a proposal is finalized it will <br />be brought forward for review as apart of a recommended exclusive negotiation agreement. <br />The Committee discussed the inclusion of the adjacent parcel at 268 Parrott as well as the <br />possibility of including the single family rental home on Washington in the development. <br />Business Development Manager Sims added that the site is currently being maintained <br />regularly by Public Works. <br />5. Discussion Regarding Significant Pending Development Applications: <br />City Manager Jermanis reported that the following item appeared in the San Leandro Times <br />today. <br />• Conditional Use Permit for Grocery Outlet (1550 East 14r~ Street) <br />Planning Manager Pollard explained that following modifications to the Zoning Code last <br />year, sites over 10,000 sq. ft. in the downtown area now require a Conditional Use Permit. <br />An application for a Conditional Use Permit was received from Grocery Outlet for 1550 East <br />3 <br />
