D. Lead-Based Paint <br />Participant agrees that all rehabilitation or construction of residential structures with <br />assistance provided under this contract shall be subject to HUD Lead-Based Paint <br />Regulations at 24 CFR 570.608, and 24 CFR Part 35, and in particular Sub-Part B thereof. <br />Such regulations pertain to all HUD-assisted housing and require that all owners, <br />prospective owners, and tenants of buildings constructed prior to 1978 be properly notified <br />that such properties may include lead-based paint. Such notification shall point out the <br />hazards of lead-based paint and explain the symptoms, treatment and precautions that <br />should be taken when dealing with lead-based paint poisoning. <br />13. RELOCATION/ANTI-DISPLACEMENT, Participant shall comply with all relocation and displacement <br />regulations and procedures applicable to all HUD assisted programs. Such regulations and procedures are <br />contained in 24 CFR Part 42 and 24 570.606; Sections 104(4), 104(k), 105(a)(11) of the Housing and <br />Community Development Act; and 42 USC 4601. <br />14, IMPROVEMENTS TO CHURCH-OWNED PROPERTY. Participants who use CDBG funds for <br />improvements to church-owned property shall enter into an agreement with the church to provide for the <br />reimbursement of the remaining .value of improvements upon cessation of use of the property for public <br />service, The agreement shall require the church to repay the Participant, or City if the Participant ceases to <br />exist, an amount not less than the value of the remaining useful life of improvements. Participant shall remit <br />the funds to the City. <br />Such agreement between Participant and church shall follow the requirements set forth in 24 CFR 570,200. <br />City will assist in determining the depreciating value of the improvements. <br />15. SECTION 504 -PROGRAM ACCESSIBILITY <br />A. General Prohibition Against Discrimination <br />No qualified individual with a handicap shall, solely on the basis of handicap, be excluded from <br />participation in, be denied the benefits of, or otherwise by subjected to discrimination by a contractor <br />receiving Federal assistance as part of the CDBG program. <br />1) Specific Prohibitions Against Discrimination <br />A contractor who receives Federal assistance as part of the CDBG program, in providing any <br />service, benefit, aid or housing may not, directly or through contractual, licensing, or other <br />arrangements, solely on the basis of handicap: (a) deny; (b) afford unequal treatment; (c) <br />provide ineffective service, benefit, aid or housing; (d) provide different service, benefit, aid or <br />housing; or (e) limit the enjoyment of any right, privilege, or advantage, to a qualified <br />individual with h andicaps the opportunity to participate in, or benefit from, the service, <br />benefit, aid or housing; <br />B.
