The environmental review and documentation, if any, required by the <br />California Environmental Quality Act (CEQA) is complete. <br />Except in the case of a referral, notice of the decision shall be mailed to the applicant by <br />first class postage, return receipt requested, to the address provided by the applicant, and shall <br />include a copy of the required findings. <br />(d) Referral to the Site Development Sub-Commission. Where the Community <br />Development Director has referred an application to the Site Development Sub-Commission, the <br />Site Development Sub-Commission shall conduct a noticed public hearing within thirty (30) <br />days of such referral, and shall issue a written decision within fifteen (15) days following the <br />hearing. Notice of the decision shall be mailed to the applicant by first class postage, return <br />receipt requested, to the address provided by the applicant, and shall include a copy of the <br />required findings. <br />(e) Effective Date; Appeals. An Interim Zoning Permit will become effective fifteen <br />(15) days after the decision of either the Community Development Director, or the Site <br />Development Sub-Commission, unless it is appealed within that time to the Board of Zoning <br />Adjustments. The decision by the Board of Zoning Adjustments on the appeal may be appealed <br />to the City Council. All appeals shall be in accordance with Article 28 of the City of San <br />Leandro Zoning Code. <br />Section 4. Environmental Review. <br />The extension of this interim ordinance is exempt from environmental review under the <br />California Environmental Quality Act pursuant to Section 15305 of the State CEQA Guidelines, <br />because it is a minor change in land use regulations that will not result in any changes to <br />underlying zoning standards. This Ordinance does not, in itself, approve any development, <br />construction, or change in use, and future projects that may be considered under the terms of this <br />interim ordinance will be subject to CEQA to the same extent as before its adoption. <br />Section 5. Effective Date. <br />This ordinance shall take effect immediately as an urgency measure for the immediate <br />preservation of public health, safety, and welfare. This Ordinance shall expire and be of no <br />further force and effect as of December 17, 2003, or until proposed Zoning Code amendments <br />are adopted, whichever occurs first. <br />Section 6. Publication. <br />The title of this ordinance shall be published once and the City Clerk shall post a <br />complete copy thereof on the City Council Chamber bulletin board for five (5) days following its <br />adoption. <br />
