to 10 pm, shall be subject to discretionary zoning review, as set forth below in Section 3. <br />B. The terms of this ordinance shall apply until such time as this ordinance, and any <br />extension thereof, has expired, or until the Development Strategy for the East 14th Street South <br />Area has been adopted by the City Council and become operative, whichever is earlier. <br />C. For purposes of this ordinance, the East 14th Street South Area includes all parcels <br />fronting East 14th Street and extending from the intersection with Thornton Avenue, south to the <br />City boundary with unincorporated Alameda County, including certain parcels zoned CC <br />northeast of the intersection of East 14th Street and 150th Avenue which do not front East 14th <br />Street, all as shown on Attachment A -Map of East 14th Street South Area, attached hereto. <br />Section 3. Administration. <br />(a) Interim Zoning Permit Required. No development subject to the terms of this <br />ordinance shall proceed unless and until an Interim Zoning Permit has been obtained pursuant to <br />the terms of this Section. <br />(b) Permit Application. An application for an Interim Zoning Permit shall be <br />submitted to the Community Development Director, and shall include a statement that the <br />applicant is the property owner or authorized agent. The Community Development Director may <br />require such information as is reasonably necessary to describe the proposed use, building, or <br />activity, including grading or other alteration of property. The Community Development <br />Director may adopt administrative procedures for the processing of Interim Zoning Permit <br />applications. <br />(c) Authority of Community Development Director. Within thirty (30) days of the <br />date the application is determined to be complete, the Community Development Director or <br />designee shall approve, conditionally approve, or deny the Interim Zoning Permit, or shall refer <br />the matter to the Site Development Sub-Commission pursuant to subsection (d). Except in the <br />case of a referral, the Community Development Director or designee shall approve, or <br />conditionally approve, the application if, on the basis of the application and other evidence <br />considered in connection therewith, findings are made that the project will conform to the <br />following standards: <br />1. The use, structure or activity complies with the objectives and the <br />provisions of the Zoning Ordinance of the City of San Leandro, including any specific <br />condition required for the proposed use in the zoning district in which it would be <br />located; and <br />2. The proposed location of the use, structure or activity and the proposed <br />conditions under which it will be operated or maintained will be consistent with the San <br />Leandro General Plan; will not be detrimental to the public health, safety or welfare of <br />persons residing, or working in, or adjacent to, the neighborhood of such use; and will not <br />be detrimental to the properties or improvements in the vicinity, or to the general welfare <br />of the City; and <br />3. The proposed use and the conditions under which it will be operated will <br />not create adverse impacts on traffic or parking, nor result in anover-concentration of <br />
