IN THE CITY COUNCIL, OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2002- 19 (10 7 6 ) <br />AN URGENCY ORDINANCE REPEALING ARTICLE 9 AND ADDING ARTICLE 9 TO <br />CHAPTER 5 OF TITLE VII OF THE SAN LEANDRO MUNICIPAL CODE, AMENDING THE <br />CALIFORNIA BUILDING STANDARDS CODE, AND ADOPTING BY REFERENCE THE <br />UNIFORM PLUMBING CODE, AS AMENDED, AND MAKING THIS MATTER AN URGENCY <br />MEASURE TO TAKE EFFECT NOVEMBER 1, 2002, PURSUANT TO SECTION 1-1-345 (f) <br />AND (b) OF THE SAN LEANDRO MUNICIl'AL CODE BECAUSE IT RELATES TO <br />PARTICULAR PROVISIONS OF LAW PRESCRIBING THE MANNER OF ITS PASSAGE AND <br />ADOPTION AND PRESERVATION OF PUBLIC SAFETY, HEALTH AND WELFARE <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />Section L Article 9 Title VII, Chapter 5 of the San Leandro Municipal Code is <br />hereby deleted. <br />Section 2. Article 9 is hereby added to Chapter 5 of Title VII of the San Leandro <br />Municipal Code to read as follows: <br />"ARTICLE 9. PLUMBING CODE <br />Section 7-5-900: ADOPTION. Except as hereinafter specifically set forth, the "California <br />Building Standards Code, 2001 edition" is amended and that certain document entitled "Uniform <br />Plumbing Code, 2000 Edition," published by the International Association of Plumbing and <br />Mechanical Officials is hereby adopted as the "Plumbing Code" of the City of San Leandro. <br />However, in accordance with California Government Code Section 50222.4, no penalty clauses <br />are adopted by reference. In the event an amendment to the California Building Standards Code <br />results in differences between these building standards and the California Building Standards <br />Code, the text of these building standards shall govern. In accordance with California Health and <br />Safety Code Section 17958.7, express findings that modifications to the California Building <br />Standards Code are reasonably necessary because of local climatic, geological or topographical <br />conditions are either already on file with the California Building Standards Commission, or will <br />be filed prior to the effective date of this Ordinance. In accordance with California Government <br />Code Section 50022.6, at least one true copy of the Uniform Plumbing Code has been on file <br />with the San Leandro City Clerk since fifteen days prior to enactment of this Ordinance. While <br />this Ordinance is in force, a true copy of the Uniform Plumbing Code shall be kept for public <br />inspection in the office of the San Leandro City Clerk. A reasonable supply of the Uniform <br />Plumbing Code shall be available in the office of the San Leandro City Clerk for public purchase. <br />Section 7-5-905: DELETIONS: ENFORCEMENT-ABATEMENT PROCEDURES <br />Sections 102.2.1, 102.2.2, 102.2.3, 102.3, 103.3.3.2, and 103.4 and Table 1-1 of the Uniform <br />Plumbing Code are hereby deleted. Enforcement and abatement procedures set forth in Articles <br />11, 12, and 13 of this Chapter shall apply to this Article. <br />
