IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE N0.2002 - 032 (1413) AN ORDINANCE AMENDING PROVISIONS OF THE SAN LEANDRO MUNICIPAL CODE RELATING TO ENFORCEMENT OF MUNICIPAL CODE VIOLATIONS WHEREAS, the City Council of the City of San Leandro ("City Council") has amended Chapter 1-12 of the San Leandro Municipal Code by adopting comprehensive provisions relating to the civil, criminal, and administrative enforcement of violations of the laws and regulations of the City of San Leandro; and WHEREAS, it is necessary and desirable to amend various provisions of the San Leandro Municipal Code to conform to the provisions of Chapter 1-12, as amended; and WHEREAS, the City Council finds that the adoption of these Code amendments is exempt from the California Environmental Quality Act ("CEQA"), pursuant to sections 15061(b){3), 15301(d), 15304, and 15308 of Title 14, Chapter 3 of the California Code of Regulations (CEQA Guidelines); and WHEREFORE, The City Council of the City of San Leandro ordains as follows: SECTION 1. Section 3-1-210 of the City of San Leandro Municipal Code is hereby amended to read as follows: 3-1-210 Declaration of Public Nuisance. Any private property, or use of private and/or public property found to be maintained in violation of the forgoing sections is hereby declared to be a public nuisance, and such violation shall be abated in the manner provided in Chapter 1-12. SECTION 2. The City of San Leandro Municipal Code is hereby amended by repealing Articles 3 through 7 of Chapter 3-1 of said Code, sections 3-1-300 through and including section 3-1-700. SECTION 3. Section 3-2-210 of the City of San Leandro Municipal Code is hereby amended to read as follows: 3-2-210 Declaration of Public Nuisance. Any property within the City of San Leandro maintained in violation of this Chapter is hereby declared to be a public nuisance, and such violation shall be abated in the manner provided in Chapter 1-12. 188745-1
