IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE N0.2002 - 032 (1413) <br />AN ORDINANCE AMENDING PROVISIONS OF THE SAN LEANDRO <br />MUNICIPAL CODE RELATING TO ENFORCEMENT <br />OF MUNICIPAL CODE VIOLATIONS <br />WHEREAS, the City Council of the City of San Leandro ("City Council") has <br />amended Chapter 1-12 of the San Leandro Municipal Code by adopting comprehensive <br />provisions relating to the civil, criminal, and administrative enforcement of violations of <br />the laws and regulations of the City of San Leandro; and <br />WHEREAS, it is necessary and desirable to amend various provisions of the San <br />Leandro Municipal Code to conform to the provisions of Chapter 1-12, as amended; and <br />WHEREAS, the City Council finds that the adoption of these Code amendments <br />is exempt from the California Environmental Quality Act ("CEQA"), pursuant to sections <br />15061(b){3), 15301(d), 15304, and 15308 of Title 14, Chapter 3 of the California Code of <br />Regulations (CEQA Guidelines); and <br />WHEREFORE, The City Council of the City of San Leandro ordains as follows: <br />SECTION 1. Section 3-1-210 of the City of San Leandro Municipal Code is hereby <br />amended to read as follows: <br />3-1-210 Declaration of Public Nuisance. <br />Any private property, or use of private and/or public property found to be <br />maintained in violation of the forgoing sections is hereby declared to be a public <br />nuisance, and such violation shall be abated in the manner provided in Chapter 1-12. <br />SECTION 2. The City of San Leandro Municipal Code is hereby amended by repealing <br />Articles 3 through 7 of Chapter 3-1 of said Code, sections 3-1-300 through and including <br />section 3-1-700. <br />SECTION 3. Section 3-2-210 of the City of San Leandro Municipal Code is hereby <br />amended to read as follows: <br />3-2-210 Declaration of Public Nuisance. <br />Any property within the City of San Leandro maintained in violation of this <br />Chapter is hereby declared to be a public nuisance, and such violation shall be abated in <br />the manner provided in Chapter 1-12. <br />188745-1 <br />
