City of San Leandro <br />Community Development Department <br />Planning Services Division <br />Staff Report <br />DATE: April 17, 2008 <br />TO: Board of Zoning Adjustments <br />FROM: Elmer Penaranda, Planner II <br />SUBJECT: Matter of PLN2008-00003; Revised Site Plan Review and Conditional Use Permit; <br />to construct a 1,342 square foot additional dwelling unit at the rear of the existing <br />single-family home at 78 Williams Street (previously proposed addition was 1,525 <br />square-feet). The addition would create a duplex. The proposed roof height of the <br />addition would be an average of 19 feet, six inches (previous design averaged <br />approximately 22 feet tall). The proposed duplex would include two covered <br />parking spaces and two surface parking spaces. Site Plan Review is required as <br />this proposal creates a new second-story dwelling unit. The conditional use permit <br />is required as the lot is 40 feet wide where 50 feet is the minimum lot width in the <br />DA-3 Downtown Area District and as two-family residences are also <br />conditionally permitted in the DA District. (Tabled at the March 6, 2008 meeting and re-noticed for the April <br />17, 2008 Board of Zoning Adjustments meeting.) <br />SUMMARY AND RECOMMENDATION <br />The application was reviewed by the Board of Zoning Adjustments at the March 6, 2008 <br />meeting. The staff report and minutes for that meeting are attached. At the March 6th meeting, <br />the Board received various opposing comments from adjacent neighbors regarding the size and <br />height of the proposed addition. Board members directed the applicant to consider revisions to <br />address the adjacent neighbors concerns. <br />The applicant revised the plans to reduce the size (i.e., height and bulk) of the proposed dwelling <br />in an effort to address the adjacent neighbors concerns. The floor area of the addition and the <br />total height of the addition were reduced. <br />With the revisions that lessen the floor area and reduce the height of the proposal, the staff <br />recommendation remains unchanged. Staff recommends that the Board of Zoning Adjustments <br />make the attached Findings of Fact and approve PLN2008-00003 subject to the recommended <br />Conditions of Approval. <br />BACKGROUND <br />The Zoning Code does not preclude two-story construction in the DA3 District. In this case, <br />because of the substandard lot, the proposal is required to undergo a conditional use permit <br />review process (Zoning Code Section 4-1650).
