IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION N0.2008-077 (1055) RESOLUTION CALLING A SPECIAL 1VIUNICIPAL RUNOFF ELECTION FOR THE ELECTION OF CITY COUNCILMEMBER, DISTRICT 2; PROVIDING NOTICE OF ELECTION ON THE 4TH DAY OF NOVEMBER, 2008 AND DIRECTING THAT SAID NOTICE BE GNEN; AND REQUESTING THAT THE ALAMEDA COUNTY BOARD OF SUPERVISORS PERMIT THE CONSOLIDATION OF SAID MUNICIPAL ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON NOVEMBER 4, 2008 AND DIRECT THE ALAMEDA COUNTY REGISTRAR OF VOTERS TO PROVIDE ALL NECESSARY SERVICES RELATED TO SAID ELECTION WHEREAS, a General Municipal Election was held on Tuesday, June 3, 2008, for the purpose of electing City Councilmembers for Districts 2, 4 and 6 for a full term of four years; and WHEREAS, no candidate for the office of City Councilmember, District 2 received at least 50% plus one of the votes cast for that office; and WHEREAS, Section 225(b) of the Charter of the City of San Leandro requires a successful candidate for elective office to receive at least 50% plus one of the votes cast for that office, and in the event that no candidate for such elective office receives 50% plus one of the votes cast for that office, the City Council shall provide for a runoff vote to determine the person elected; and WHEREAS, Ordinance No. 2006-008 of the City Council of the City of San Leandro sets forth the procedure for the conduct of runoff elections among the two persons having the highest number of votes for an office by requesting the Alameda County Board of Supervisors to permit the consolidation of the City's Municipal Runoff Election with the Statewide General Election in November following the City's General Municipal Election. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN LEANDRO DOES RESOLVE AS FOLLOWS: SECTION 1. Pursuant to the provisions of Sections 225(b) and 605 of the Charter of the City of San Leandro, the City Council hereby calls a Special Municipal Runoff Election, to be held on November 4, 2008, among the two persons having the highest number of votes for the office of City Councilmember, District 2, in the June 3, 2008 General Municipal Election. SECTION 2. Notice of the time and place of holding said election is hereby given and the City Clerk as the Elections Official of the City of San Leandro is hereby directed to publish, post and give such further additional notice of said election as prescribed by the Elections Code of the State of California, and to take such other actions as may be deemed necessary and
