Jermanis <br />City Manager <br />MATTER OF CONSIDERATION OF PLACING AN EMERGENCY COIVIMUNICATION <br />SYSTEM ACCESS TAX MEASURE BEFORE THE VOTERS AT THE NOVEMBER 2008 <br />ELECTION, SUBMITTING ARGUMENTS FOR THE MEASURE AND APPROVING THE <br />FORM OF THE MEASURE <br />SUMMARY AND RECOMMENDATION <br />Staff is recommending that an Emergency Communication System Access Tax for enhanced 911 <br />services be placed before the voters on the November 2008 election. The Measure, if adopted, <br />would rescind the City's current Emergency Communication Access Fee Ordinance, update <br />certain elements of the ordinance and address legal concerns. There would be no change to the <br />existing rate structure. Because the revenues from the tax are restricted, it would be a "special <br />tax" under Prop. 218 and will require a 2/3 favorable vote for adoption. <br />Accordingly, staff is recommending that Council take the following actions at the July 28, 2008 <br />City Council meeting. <br />1. Adopt a resolution which: <br />a. submits the Emergency Communication System Access Tax ordinance to the voters at the <br />November 4, 2008 general municipal election and if adopted repeals the current fee; <br />b. approves the Form of the Ballot Question; <br />c. sets forth procedures for Ballot Arguments; and <br />d. directs the City Clerk to submit the measure to the City Attorney for impartial <br />analysis; and <br />e. directs the City Clerk to request the services of the Alameda County Registrar of <br />Voters to conduct the election. <br />2, By motion, appoint the Revenue Ad Hoc Committee of the City Council to author a <br />Ballot Argument in favor of the amendment. <br />3. Approve the form of the ordinance for the Emergency Communications Access Tax. <br />
