J rmanis City nager RESOLUTION AUTHORIZING AN AMENDMENT TO A LEGAL SERVICES AGREEMENT WITH THE LAW FIRM OF MEYERS, NAVE, RIBACK, SILVER & WILSON (MEYERS NAVE) TO PROVIDE CITY ATTORNEY SERVICES TO THE CITY OF SAN LEANDRO SUMMARY AND RECOMMENDATION It is recommended that the City Council approve a resolution authorizing Amendment No. 3 to the Legal Services Agreement with Meyers Nave to provide legal services to the City of San Leandro as City Attorney. The proposed amendment clarifies the scope of legal services performed by the City Attorney and authorizes an increase in rate. The City Council Finance Committee met on July 29, 2008 and reviewed the legal services agreement. Following a discussion with the City Manager and City Attorney on cost comparisons with other cities, the Committee recommended Amendment No. 3 with the Law Firm of Meyers Nave be forwarded to the City Council for approval. BACKGROUND On March 13, 1986, the City entered into an Agreement with the law firm of Meyers, Nave, Riback, Silver & Wilson, to provide legal services to the City of San Leandro as City Attorney. The Agreement with Meyers Nave at that time provided for the continuation of City Attorney services provided by Steve Meyers who had served as the City Attorney since 1979. Since that time, the City has authorized two (2) amendments to the Agreement, the most recent being in July 2005. This proposed amendment will serve to further clarify the scope of services performed by Meyers Nave and provides for an increase in rates. DISCUSSION: The current Agreement provides for four (4) categories of legal services: Basic Services (retainer); Special Services (hourly rate); Cost Recovery (hourly rate); and Other Services
