Hollister <br />Interim City Manager <br />Kathy Ornelas, Community Relations Representatives <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />AN ORDINANCE AMENDING TITLE 4, CHAPTER 22 OF THE SAN LEANDRO <br />MUNICIPAL CODE RELATING TO CHARITABLE SOLICITATION PERMITS <br />SUMMARY AND RECOMMENDATION <br />It is recommended that the San Leandro Municipal Code sections relating to charitable <br />solicitation permits be revised. <br />BACKGROUND <br />Analysis <br />The Municipal Codes and processes for issuance of charitable solicitation permits through the <br />City Clerk's Office were last updated in 1983. Staff is recommending a number of changes be <br />made to the codes and application process to be more inclusive of information required by permit <br />applicants. <br />While many of the changes to the sections are for clarification of procedures or re-numbering for <br />simplification, some new requirements have been added. For instance, the applicant will be <br />required to provide proof that the organization has tax exempt status by providing documentation <br />from the Internal Revenue Service, the California Franchise Tax Board, or the California <br />Secretary of State. <br />Also, the name and address of any solicitor collecting under the authority of the permit must be <br />listed on the application, as well as on the actual permit carried by the solicitors. No person will <br />be allowed to solicit for contributions unless their name is listed on the permit. <br />The current code requires submission of a financial statement for the preceding fiscal year from <br />the charitable organization, as well as a report of the total amount raised within 30 days after the <br />expiration of the permit. Amendments to the code will allow the City Manager to request these <br />reports as necessary. <br />Amendment of § 4-22-220 will list grounds for denial of a permit i£ <br />1) the applicant has not complied with the provisions of this Chapter; <br />2) the applicant has falsified or intentionally supplied misleading or false information on <br />the permit application; <br />
