(applicant and property owner) <br />THIS AGREEMENT is entered into by and between the CITY OF SAN LEANDRO, a municipal <br />corporation, hereinafter referred to as "City," and Dynamic Builders, h7c., a California Corporation, <br />.hereinafter refen-ed to as "applicant and property owner". <br />Applicant applied for and received approval of a Variance to construct a building to a maximum <br />height of 65 feet, where the maximum allowable height is 50 feet in the industrial districts; <br />Parking Exception to provide 108 parking spaces where the total required is l 56 parking spaces; <br />and Site Plan Review to construct a new 205,000 square foot storage facility with loading docks, <br />and administrative offices for a frozen goods storage company; 400 Hudson Lane; Alameda <br />County Assessor's Parcel Numbers 75-87-1-2 and 75-87-8. <br />NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is <br />mutually agreed as follows: <br />l . Applicant agrees to comply with the Conditions of Approval adopted by the City of San <br />Lea~~dro Board of Zoning Adjustments, more specifically described in the list of Conditions of <br />Approval, attached hereto, and as described in the exhibits on file in the Community Development <br />Department, all of which are incorporated herein by this reference. <br />2. This agreement shall be binding upon and inure to the benefit of the parties hereto and <br />Nleir respective heirs, successors, and assigns. <br />3. City is authorized to record this agreement and any amendments thereto with the <br />Alameda County Recorder, California. All amendments hereto must be in writiiZg and signed by <br />the appropriate authorities of the City and Applicant. The Applicant will be charged the costs of <br />recordation and agrees to pay same.
