Any and all previous approvals related to this subject <br /> property shall remain in effect except as hereinafter modified within this agreement and associated <br /> conditions of approval. Said Agreements having been recorded August 27, 2008 as <br /> Instrument No. 2008262750 and 2008262749, respectively in Official Records <br /> NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is <br /> mutually agreed as follows: <br /> 1. Applicant agrees to comply with the Conditions of Approval required by the City of San <br /> Leandro Community Development Director, more specifically described in the exhibits on file in <br /> the Community Development Department, all of which are incorporated herein by this reference. <br /> In addition, Applicant agrees to comply with the Conditions of Approval described on Exhibit A <br /> attached hereto as conditions (V)(BB) and (CC). The City acknowledges and agrees that all on site <br /> construction and improvements with respect to this project have been completed and inspected and <br /> approved by the appropriate parties and all fees in connection with the development of the project <br /> have been paid in full, except for any unpaid out of pocket costs of the City in connection with the <br /> construction of the wall adjacent to the project and out of pocket costs associated with the offsite <br /> improvements, which costs have currently been paid in full through the end of June 2015 (with <br /> Applicant having a deposit balance of$26,824.48 as of the end of June 2015).
