Alcohol Ban 2 December 15, 2008 • Reorganize and update the entire article by reordering the sections and removing outdated reference to Section 7-3-151 of the San Leandro Zoning Code. Title 7, Chapter 1 of the San Leandro Administrative Code outlines the rules and regulations for the use of public parks and recreational facilities. The proposed resolution amends §7.1.100 to add the alcohol ban to these rules and regulations. The resolution will take effect on the same date as Ordinance No. 2008-016. Current City Council Policy Not Applicable Previous City Council Action(s) On December 1, 2008, the City Council passed to print Ordinance No. 2008-016, amending Chapter 4-1, Article 7 of the San Leandro Municipal Code to ban alcohol use in City park and open space areas except for City-sponsored events with prior approval from the City Council. City Council Committee Review and Action On November 4, 2008, the City Council Facilities and Transportation Committee recommended that an ordinance banning alcohol use in City park and open space areas with the exception of City sponsored events with prior approval by the City Council be forwarded to the City Council. Applicable General Plan Policy Not applicable Permits and/or Variances Granted Not applicable Environmental Review Not applicable Code Compliance Review Not applicable ^ Board/Commission Findings Through many meetings and discussions with the community and City staff; including Police, Public Works and Recreation and Human Services, the Recreation and Parks Commission determined that the majority of issues and calls to police are in response to groups using alcohol; the high use of parks means that the excessive noise, conflict and illegal parking problems heightened by alcohol use impact other park users as well as neighbors, and the cities and districts surrounding the City of San Leandro ban alcohol use. Summary of Public Outreach Efforts Problems of park use and the possibility of banning alcohol use in parks were placed on the agenda at the Recreation and Park Commission meetings of June 4, 2008; July 9, 2008; September 3, 2008; and October 1, 2008. All meetings were noticed and open to the public.
