SAN LEANDRO SLOUGH BRIDGE <br />SAN LEANDRO SLOUGH AND DAVIS STREET <br />CITY OF SAN LEANDRO <br />OYSTER BAY REGIONAL SHORELINE <br />EAST BAY REGIONAL PARK DISTRICT <br />AND <br />CITY OF SAN LEANDRO <br />MAINTENANCE AND OPERATIONS AGREEMENT <br />THIS AGREEMENT is made and entered into this j day of f 1 2009. by and <br />between the EAST BAY REGIONAL PARK DISTRICT. hereinafter called "District." and the <br />CITY OF SAN LEANDRO, hereinafter called "City." <br />WITNESSETH: <br />WHEREAS District, owns submerged and upland portions of the San Francisco Bay commonly <br />known as the Oyster Bay Regional Shoreline to be used and operated as a water -oriented park <br />and recreational area (the "Park" ); and <br />WHEREAS District and City, in cooperative agreement desire to construct a pedestrian/bicycle <br />bridge (the "Bridge") on a defined portion of the Park; and <br />WHEREAS District has reviewed and approved the construction plans for the Bridge; and <br />WHEREAS District. for a good and valuable consideration and in further consideration of the <br />faithful performance and observance by City of all the terms and conditions herein contained, <br />does hereby agree to enter into an agreement with City for the maintenance and operation of the <br />Bridge; <br />NOW THEREFORE. District and City enter into this Agreement upon the following terms and <br />conditions, and City does hereby agree with District as follows: <br />Definitions: <br />As used in this Agreement, "the Park" shall refer to that property owned by the District <br />and located west of the end of Davis Street, San Leandro, as shown on the map attached <br />hereto as Exhibit "A". <br />As used in this Agreement, "the Bridge" shall refer to the physical infrastructure and <br />pedestrian bridge installed and owned by City as approved by the District as shown on <br />Slough Bridge <br />1-21-09 <br />
