SUMMARY REPORT PURSUANT TO SECTIONS 33445 AND 336'79 OF THE <br />CALIFORNIA COMMUNITY REDEVELOPMENT LAW REGARDING PAYMENT BY <br />THE SAN LEANDRO REDEVELOPMENT AGENCY FOR A PORTION OF THE COST <br />OF CONSTRUCTION OF A SCHOOL GYMNASIUM AND RELATED PUBLIC <br />IMPROVEMENTS OF BENEFIT TO THE ALAMEDA COUNTY-CITY OF SAN <br />LEANDRO JOINT REDEVELOPMENT PROJECT AREA <br />Introduction <br />Section 33445(a) of the California Community Redevelopment Law (California Health <br />and Safety Code Section 33000 et seq.) (the "Redevelopment Law") requires that the legislative <br />body make certain findings prior to a redevelopment agency's expenditure of tax increment <br />funds for public improvements. These findings must show that (1) the public improvements will <br />be of benefit to a redevelopment project area or the immediate neighborhood in which the project <br />is located; (2) no other reasonable method of financing the public improvements is available to <br />the community; (3) the public improvements will assist in the elimination of one or more <br />blighting conditions inside the project area; and (4) the agency's assistance for the public <br />improvements is consistent with the its current five-year implementation plan. <br />Furthermore, in cases where the public improvement is a publicly owned building, <br />Section 33679 of the Redevelopment Law requires the agency to hold a public hearing. For at <br />least two consecutive weeks prior to the hearing, the agency must publish a notice in a <br />newspaper of general circulation. The agency must also make available to the public <br />information outlining (a) estimates of the amount of tax increment funds proposed to be used, <br />including interest payments; (b) the facts supporting the legislative fmdings, as outlined by <br />Section 33445 of the Redevelopment Law; and (c) the redevelopment purpose for which the tax <br />increment funds are to be used. <br />This Summary Report has been prepared in compliance with Sections 33445 and 33679 <br />of the Redevelopment Law. <br />Project Description <br />The San Leandro Unified School District (the "District") is constructing a gymnasium, a <br />three-story classroom building and cafeteria for the Ninth Grade Campus located at 13701 <br />Bancroft Avenue, San Leandro, within the Joint Alameda County-City of San Leandro <br />Redevelopment Project Area (the "Project Area"). Public infrastructure improvements <br />including curbs and gutters, sidewalks, and asphalt improvements to the drop-off area will also <br />be installed. Construction began in November 2008. <br />The City of San Leandro (the "City") and the District contemplate entering into a "Joint <br />Use Agreement" which provides for residents' use of the gymnasium during non-school hours. <br />The San Leandro Redevelopment Agency (the "Agency") and the District contemplate entering <br />into a "Financing Agreement" providing for financial contributions and certain in-kind <br />contributions to the Project from the Agency as specified herein. <br />
