CONDITIONS OF APPROVAL <br />PLN2008-00017 <br />262 Braadmoor Boulevard <br />Alameda County Assessor's Parcel Number 76-272-6 <br />M. and P. Silva (applicants and property owners) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant shall comply with Exhibits A through E, attached to the staff report dated <br />July 17, 2008, except as hereinafter modified. (Exhibits are on file at the City of San <br />Leandro Community Development Department, 835 East 14th Street, San Leandro, <br />California). <br />Exhibit A -Vicinity Map and Site Plan <br />Exhibit B -Section and Floor Plan of Proposed Rear Secondary Unit/Garage <br />Exhibit C -Elevations of Proposed Rear Secondary Unit/Garage <br />B. The applicant and/or property owner shall be responsible for assuring that any successor <br />in interest who assumes responsibility for this zoning approval is informed of its terms <br />and conditions. <br />C. Construction shall commence within one (1) year following Board of Zoning <br />Adjustments approval of the Conditional Use Permit and shall be substantially <br />completed one year after commencement of construction. For the purpose of <br />compliance with this condition, commencement of construction shall be defined as <br />the pouring or construction of a substantial portion of the building foundation <br />structures. Pursuant to Zoning Code Section 5-2218, this approval shall lapse on July <br />17, 2009 unless a) a building permit has been issued, coupled with diligent progress <br />evidencing a good faith intent to commence the intended use, or b) a written request for <br />a one-year extension of the use permit is approved by the Zoning Enforcement Official. <br />II. USE RESTRICTIONS <br />A. This conditional use permit and site plan review approves construction of a detached <br />1,236 square-foot two-story accessory structure consisting of a garage and a <br />secondary dwelling unit on the northeastern corner of the site, to the rear of the <br />existing 3,721 square-foot two-story home at 262 Broadmoor Boulevard. Said parcel <br />is also known as Alameda County Assessor's Parcel Numbers 76-272-6; M. and P. Silva <br />(applicants and property owners). <br />B. Any changes to the approved exterior design of the accessory structure shall be <br />submitted in writing as a request to the Community Development Director. The request <br />shall include but is not limited to the reason(s) for the change(s) to the exterior design <br />and exhibits that shall be neat, accurate, to scale, including dimensions, colors materials <br />and finishes. <br />Conditions of Approval June 17, 2008 <br />PLN2008-00017 Page 3 of 8 <br />
